UN Secretary General, António Guterres and the International Civil Service Commission
On 3 July 2019, the International Labour Organization Administrative Tribunal (ILOAT) ruled that pay cuts recommended by the International Civil Service Commission (ICSC) for Geneva were illegal and ordered that they be cancelled.

However, the judgement only applies to certain specialized agencies, and not the UN, which does not fall under the jurisdiction of the ILOAT. This now creates two pay scales in Geneva: a higher, legal pay scale, and a lower, illegal one.

More generally the judgement raises questions about how the ICSC makes its recommendations and how organizations apply changes that have a negative impact on staff.

In light of this judgement, the personnel of the United Nations and specialized agencies call on the Secretary-General of the United Nations and the International Civil Service Commission (ICSC) to:

  • Remedy the substantive and procedural errors committed by the ICSC in calculating pay, and apply a single pay scale to all UN personnel in Geneva;
  • Review how the issues raised by the judgement impact cuts to GS staff pay, the imposition of secondary and tertiary salary scales, and pay cuts for P and FS staff worldwide;
  • Support and fully implement the fundamental principle of equal pay for equal work across the UN system; and
  • Make personnel an equal partner in deciding how their conditions of service are set.

Le 3 juillet 2019, le Tribunal administratif de l'Organisation internationale du Travail (TAOIT) a déclaré illégales les coupes salariales recommandées par la Commission de la Fonction Publique Internationale (CFPI) pour Genève et a ordonné leur annulation.

Comme le jugement ne s'applique qu'à certaines agences spécialisées, et non à l'ONU, qui ne relève pas de la compétence du TAOIT, nous allons nous retrouver avec deux grilles salariales à Genève : une plus élevée, légale, et une plus faible, illégale.

De manière générale, ce jugement soulève des questions sur la manière dont la CFPI formule ses recommandations et dont les organisations appliquent les changements qui ont un impact négatif sur le personnel.

À la lumière de ce jugement, les fonctionnaires de l’ONU et des institutions spécialisées appellent le Secrétaire général de l’ONU et la Commission de la Fonction Publique Internationale (CFPI) à :

  • Rectifier les erreurs de fond et de procédure commises par la CFPI dans le calcul des salaires et appliquer une grille salariale unique à tout le personnel de l'ONU à Genève ;
  • Examiner comment les questions soulevées par le jugement affectent le calcul négatif du salaire des agents des services généraux, l'imposition de barèmes de salaires secondaires et tertiaires et les réductions de salaires des fonctionnaires des catégories P et FS dans le monde entier ;
  • Soutenir et mettre pleinement en œuvre le principe fondamental de l'égalité de salaire pour un travail égal dans l'ensemble du système des Nations Unies ; et
  • Faire en sorte que le personnel devienne un partenaire à part entière dans les décisions relatives aux conditions d'emploi.
