Thưa Quý vị,

Chúng tôi, những người ký tên dưới đây, kêu gọi sự chú ý đặc biệt và hành động khẩn cấp của Quý vị về một án tử hình đang diễn ra tại Việt Nam, vụ án Hồ Duy Hải.

Quá trình điều tra và xét xử vụ án đã đặt ra nhiều nghi vấn và gây quan ngại sâu sắc trong cộng đồng người Việt trong và ngoài nước. Kể từ năm 2008 đến nay, đã có rất nhiều kiến nghị được gửi tới các cơ quan có thẩm quyền của Việt Nam đề nghị xem xét lại vụ án này (vui lòng xem các mốc chính của vụ án Hồ Duy Hải trong Phụ lục 1 dưới đây).

Cao ủy Nhân quyền Liên Hiệp Quốc, Tổ chức Thế giới Chống Tra tấn, Ân xá Quốc tế, Liên minh Châu Âu cùng nhiều tổ chức bảo vệ nhân quyền khác đã tiến hành điều tra, công bố các báo cáo độc lập về vụ án và gửi thư tới Chủ tịch nước, Chính phủ, Quốc hội nước CHXHCN Việt Nam (vui lòng xem liên kết đến các tài liệu này tại Phụ lục 2 ) đề nghị ngừng thi hành án đối với Hồ Duy Hải để xem xét lại, áp dụng các nguyên tắc điều tra chuẩn mực và đặc biệt là tôn trọng quyền được suy đoán vô tội của bị cáo trong thủ tục tố tụng.

Từ ngày 6/5 đến ngày 8/5/2020, Hội đồng Thẩm phán Tòa án Nhân dân Tối cao - đứng đầu là Chánh án Nguyễn Hòa Bình - xét xử giám đốc thẩm vụ án. Ông Nguyễn Hòa Bình từng là người phụ trách cấp cao của Cơ quan cảnh sát điều tra và sau đó, trên cương vị Viện trưởng Viện Kiểm sát Nhân dân Tối cao đã ra quyết định không kháng nghị vụ án vào năm 2011.

Với biểu quyết tán thành của 17/17 thành viên, Hội đồng Thẩm phán kết luận “ Quá trình điều tra, xét xử có thiếu sót nhưng việc này không làm thay đổi bản chất vụ án. Do vậy không cần thiết phải hủy các bản án sơ thẩm, phúc thẩm để điều tra lại theo kháng nghị giám đốc thẩm của Viện trưởng Viện Kiểm sát Nhân dân Tối cao ”.

Với các thông tin chính thức về vụ án đã được công bố, chúng tôi nhận thấy có rất nhiều điểm sai phạm, thiếu minh bạch trong quá trình điều tra và xét xử, cho thấy những quyền con người cơ bản của Hồ Duy Hải đã không được tôn trọng.

Điều này vi phạm các chuẩn mực quốc tế về nhân quyền mà nhà nước CHXHCN Việt Nam đã ký kết, trong đó có Công ước Quốc tế về các quyền Dân sự và Chính trị 1966, Công ước chống tra tấn 1984, Tuyên bố Nhân quyền ASEAN 2012 cũng như các thỏa thuận song phương với Liên minh Châu Âu, Hoa Kỳ, Thụy Sĩ, Na Uy và Úc. Điều này cũng vi phạm các điều khoản bảo vệ quyền con người được quy định trong Hiến pháp nước CHXHCN Việt Nam và đặc biệt là vi phạm nghiêm trọng ngay cả Bộ luật Tố tụng Hình sự 2015 của Việt Nam.

Vì vậy, chúng tôi khẩn thiết đề nghị:

1. Chủ tịch nước CHXHCN Việt Nam quyết định tạm dừng thi hành án tử hình đối với Hồ Duy Hải.

2. Ủy ban Thường vụ Quốc hội nước CHXHCN Việt Nam thành lập Ủy ban giám sát vụ án để đánh giá lại tính khách quan và chính xác của phiên giám đốc thẩm. Nếu phát hiện sai sót nghiêm trọng, Quốc hội tiến hành bãi nhiệm Chánh án Tòa án Nhân dân Tối cao và các thành viên Hội đồng thẩm phán, bầu chánh án và phê chuẩn các thẩm phán mới.

3. Hội đồng Thẩm phán Tòa án Nhân dân Tối cao (mới) mở phiên họp xem xét lại Quyết định giám đốc thẩm của Hội đồng thẩm phán đối với vụ án Hồ Duy Hải ngày 8/5/2020, qua đó chấp nhận Quyết định kháng nghị của Viện trưởng Viện Kiểm sát Nhân dân Tối cao, hủy các bản án kết án tử hình Hồ Duy Hải để tiến hành điều tra và xét xử lại vụ án.

4. Các tổ chức bảo vệ nhân quyền, bộ ngoại giao các nước đã ký các hiệp ước dựa trên cơ sở tôn trọng các quyền con người phổ quát đang hợp tác với Việt Nam có những động thái can thiệp cần thiết để sự hợp tác mang đầy đủ ý nghĩa mà nó phải có.

Thực hiện những điều này, Quý vị không chỉ cứu mạng sống của một con người mà còn góp phần bảo vệ công lý và củng cố niềm tin vào pháp luật của người dân Việt Nam.

PHỤ LỤC 1: Các mốc chính của vụ án Hồ Duy Hải

Ngày 22/3/2008, Hồ Duy Hải, sinh năm 1985, bị bắt và sau đó bị kết tội giết hai phụ nữ, bất chấp thực tế là dấu vân tay và vết máu ở hiện trường không phải của anh, không có chứng cứ thuyết phục nào chứng tỏ anh có liên quan đến vụ án, cũng như, có nhân chứng khai đã nhìn thấy những người đàn ông khác tại hiện trường vụ án trong hôm xảy ra vụ án mạng.

Các vật chứng - con dao và chiếc thớt có vết máu trong biên bản khám nghiệm hiện trường - đã không được thu giữ, mà bị tiêu hủy ngay sau khi khám nghiệm. Theo cáo trạng, dao và thớt đã được mua ở chợ địa phương rồi đưa ra và điều tra viên cho rằng chúng khớp với kích cỡ và hình dạng của dao và thớt được cho là hung khí giết người.

Ngay sau khi khởi tố vụ án, Cơ quan Cảnh sát điều tra Công an tỉnh Long An đã có công văn gửi Đoàn Luật sư tỉnh Long An, yêu cầu đích danh luật sư Võ Thành Quyết - nguyên là Thủ trưởng Cơ quan Cảnh sát điều tra Công an tỉnh Long An và Trưởng Công an huyện Thủ Thừa (địa bàn xảy ra vụ án) - làm luật sư chỉ định cho Hồ Duy Hải mà gia đình hoàn toàn không hay biết.

Tòa án nhân dân tỉnh Long An mở phiên tòa sơ thẩm kết án Hồ Duy Hải về tội “giết người” và “cướp tài sản”, tuyên mức án tử hình vào tháng 12/2008.

Bị cáo Hồ Duy Hải kháng cáo kêu oan và gia đình Hải mời luật sư Nguyễn Văn Đạt bào chữa, sau có thêm sự hỗ trợ pháp lý của luật sư Trần Hồng Phong. Tuy nhiên, luật sư bào chữa cho Hồ Duy Hải do gia đình mời đã gặp nhiều cản trở trong việc tiếp xúc bị cáo và không được tham gia các buổi thẩm vấn Hồ Duy Hải.

Các buổi thăm gặp giữa gia đình và Hồ Duy Hải luôn bị giám sát chặt chẽ, các trao đổi về vụ án bị nghiêm cấm. Tuy nhiên, Hải nói với mẹ và dì của mình rằng anh đã bị điều tra viên đánh đập và tra tấn trong thời gian bị giam giữ trước ngày mở phiên tòa.

Ngày 28/4/2009, Tòa Phúc thẩm Tòa án Nhân dân Tối cao tại Thành phố Hồ Chí Minh tuyên y án sơ thẩm.

Ngày 24/10/2011, Viện trưởng Viện Kiểm sát Nhân dân Tối cao Nguyễn Hòa Bình - người trước đó là lãnh đạo Cơ quan Cảnh sát điều tra Bộ Công an trong thời gian điều tra vụ án - ban hành Quyết định không kháng nghị vụ án và đề nghị Chủ tịch nước bác đơn xin ân giảm án tử hình của Hồ Duy Hải.

Đầu năm 2012, luật sư Trần Hồng Phong đưa ra các dấu hiệu vi phạm pháp luật nghiêm trọng trong quá trình điều tra xét xử vụ Hồ Duy Hải, đặc biệt là tất cả những thông tin liên quan đến một nghi can khác là Nguyễn Văn Nghị đều đã bị rút khỏi hồ sơ vụ án một cách bất thường. Vì thế ông đề nghị xem xét lại vụ án theo thủ tục giám đốc thẩm.

Năm 2014, luật sư Trịnh Minh Tân tiếp tục tố giác dấu hiệu vi phạm pháp luật trong việc điều tra tố tụng vụ Hồ Duy Hải và đưa ra đề nghị tương tự.

Do áp lực từ cả công chúng ở Việt Nam và các tổ chức quốc tế, ngày 4/12/2014 Chủ tịch nước khi đó là ông Trương Tấn Sang đã ra lệnh tạm dừng tử hình Hồ Duy Hải chỉ một ngày trước khi bản án được thi hành.

Tháng 2/2018, Ủy ban Tư pháp của Quốc hội Việt Nam khóa 14 kiến nghị xem xét kháng nghị giám đốc thẩm vụ án.

Ngày 14/3/2018, Ân xá Quốc tế kêu gọi Việt Nam hủy bỏ án tử hình cho Hồ Duy Hải.

Tháng 5/2018, một bản kiến nghị với 25.000 chữ ký của công dân Việt Nam được gửi tới Chủ tịch nước Trần Đại Quang để kêu oan cho Hồ Duy Hải.

Ngày 25/10/2019, Tổng Thư ký Ân xá Quốc tế Na Uy John Peder Egenaes gửi thư cho Chủ tịch nước Nguyễn Phú Trọng kèm theo chữ ký của 25.487 công dân Na Uy, kêu gọi hủy án tử hình cho Hồ Duy Hải.

Ngày 22/11/2019, Viện Kiểm sát Nhân dân Tối cao ra Quyết định kháng nghị giám đốc thẩm vụ án Hồ Duy Hải vì những thiếu sót, vi phạm trong quá trình điều tra, tố tụng và khẳng định “ những thiếu sót, vi phạm nêu trên đã trực tiếp ảnh hưởng đến giá trị chứng minh của chứng cứ theo quy định của pháp luật, ảnh hưởng nghiêm trọng đến những căn cứ kết luận hành vi phạm tội của bị cáo ”, từ đó đề nghị Tòa án Nhân dân Tối cao hủy toàn bộ bản án hình sự sơ thẩm và phúc thẩm.

Từ ngày 6/5 đến ngày 8/5/2020, Hội đồng Thẩm phán Tòa án Nhân dân Tối cao - đứng đầu là Chánh án Nguyễn Hòa Bình - xét xử giám đốc thẩm vụ án. RE: PETITION TO DEMAND JUSTICE FOR DEATH ROW INMATE HO DUY HAI

Dear Sirs and Madams:

We, the undersigned, are pleading for your special attention and immediate action with an ongoing death penalty case in Vietnam, the case of Mr. Ho Duy Hai (please see the Annex 1 for the main bullet points of Ho Duy Hai’s case).

Throughout the investigation and trial proceedings of Mr. Ho Duy Hai’s case, there have been many doubts that the government could prove his liability, which angered many Vietnamese citizens living both inside and outside the country. From 2008, petitions were sent to many departments and agencies in Vietnam, asking for a review of this case.

The UN High Commissioner for Human Rights, the Special Rapporteur for the Convention Against Torture, Amnesty International, the EU, and many other human rights organizations have investigated and reported the case. Many letters were sent to the President of Vietnam, Vietnam’s National Assembly and government (see Annex 2 for the links to relevant documents) to ask for a halt on Ho Duy Hai’s execution. These requests were based on the fact that the case should be reviewed because the criminal proceedings failed to present relevant evidence. Ho Duy Hai’s right of presumptive innocence was also violated.

From May 6 to May 8, 2020, the Judicial Committee of the People’s Supreme Court with Mr. Nguyen Hoa Binh as the Chief Justice conducted the cassation trial of Ho Duy Hai. Mr. Nguyen Hoa Binh, as stated before, was one of the high leaders of the investigative police agency, and later, as the Chief of the People’s Supreme Procuracy Office, he also refused to ask for a cassation trial in 2011.

The Judicial Committee voted with 17/17 and concluded: “ The investigation and court proceedings have deficiencies, but they did not change the character of the case. Therefore, we do not need to void the trial and appellate courts’ decisions and order a new investigation as requested by the People’s Supreme Procuracy Office .”

With the information regarding the case that has been publicly released, we view the evidence of Ho Duy Hai contains many mistakes, lack of transparency during both the investigation and criminal trial that violated Ho Duy Hai’s fundamental human rights.

This case violated the human rights standard, which the Socialist Republic of Vietnam has signed and rectified, including the International Covenant on Civil and Political Rights 1966, Convention Against Torture 1984, ASEAN Human Rights Declaration 2012. Also, Vietnam had signed a dual agreement on human rights with the EU, the U.S., Switzerland, Norway, and Australia. This case also violated the human rights section under Vietnam’s Constitution of 2013 and severely impaired the Code of Criminal Procedures 2015.

Therefore, we sincerely request:

1. The President of the Socialist Republic of Vietnam orders halting the execution of Ho Duy Hai.

2. The Standing Committee of the Socialist Republic of Vietnam’s National Assembly conducts a Review Committee to evaluate the neutrality and accuracy of the cassation trial. If the Review Committee observed severe mistakes, the National Assembly would discharge the Chief Justice of the People’s Supreme Court and all of the members of the Judicial Committee. The new Chief Justice and the Judicial Committee should be reassigned and confirmed.

3. The new Judicial Committee of the People’s Supreme Court should meet and discuss the May 8, 2020 decision of the cassation trial in Ho Duy Hai’s case. The new Judicial Committee should consider and accept the petition of the Chief of the People’s Supreme Procuracy Office to void the trial and appellate courts’ decisions regarding Ho Duy Hai and order a new investigation and prosecution.

4. The human rights organizations, ministries of foreign affairs of those countries who have signed human rights agreement with Vietnam should intervene so that those agreements would highlight the cooperation in a meaningful manner that they should have.

Complying with these requests, you not only save the life of an innocent man, but you would also contribute to the understanding of the rule of law for Vietnamese people.

ANNEX 1: The main bullet points of Ho Duy Hai's case

On March 22, 2008, Ho Duy Hai - born in 1985 - was arrested and later being charged with the murders of two women. However, the fingerprints and blood samples collected at the crime scene were not matched with Hai. There had not been any physical evidence to prove Hai was related to the case, as well as an eyewitness provided he saw some other men at the crime scene on the day the murders happened.

The alleged murdering weapons - a knife and a wood cutting board with victims’ blood - were reported in the investigative report, but the police failed to collect and keep them. These weapons were later destroyed. In the indictment against Hai, the police acknowledged they bought a different knife and cutting board at the local market and wrongfully marked them as murdering weapons in the case.

Immediately after Hai was indicted, the investigating police petitioned to the Bar Association of Long An Province, asking attorney Vo Thanh Quyet to represent Ho Duy Hai. Mr. Vo Thanh Quyet was a former Head of the Investigative Police Unit of Long An and the Head of Thu Thua District (where the crime happened). Ho Duy Hai’s family did not get any notification about Mr. Quyet’s involvement and could not trust that he provided adequate representation.

The trial court found Ho Duy Hai guilty of murder and sentenced him to death in December 2008.

Ho Duy Hai’s family appealed the judgment and hired attorney Nguyen Van Dat to represent him. Later, the representation also retained attorney Tran Hong Phong to join. However, during this time, Ho Duy Hai’s attorneys were not allowed to meet with him and could not participate in any of the interrogations.

The police strictly observed the visitations of Ho Duy Hai and his family so that they could not discuss his case. Nevertheless, Hai told his mother and aunt that he was beaten by the investigative police and tortured while he was held before his trial.

On April 28, 2009, The Appellate Division of the People’s Supreme Court in Ho Chi Minh City affirmed the trial court’s decision.

On October 24, 2011, the Head of the People’s Supreme Procuracy Office - Nguyen Hoa Binh - declined to petition for a cassation trial and suggested the President of Vietnam deny Ho Duy Hai’s request for a pardon to reduce the death penalty sentence. Mr. Nguyen Hoa Binh was the leader of the investigative police force when the murders in Ho Duy Hai’s case were being investigated.

At the beginning of the year 2012, attorney Tran Hong Phong exposed the serious violations in Ho Duy Hai’s appeal hearing, especially all information about Nguyen Van Nghi, one of the top suspects, was withdrawn from the case. Phong, therefore, requested for a review of the case under a cassation trial.

In 2014, attorney Trinh Minh Tan continued bringing illegal conduct during the criminal proceedings of Ho Duy Hai’s case and also made the same request as attorney Tran Hong Phong did two years before.

After the Vietnamese public and a few international human rights organizations pressured the government, on December 4, 2014, Vietnam’s President at the time, Truong Tan Sang, ordered a halt of Ho Duy Hai’s execution, one day before it would happen.

In February 2018, the Committee on Judicial Affairs Vietnam’s 14th National Assembly petitioned to have Ho Duy Hai’s case being reviewed under the cassation trial.

On March 14, 2018, Amnesty International called on Vietnam to cease Ho Duy Hai’s death penalty sentence.

In May 2018, 25,000 Vietnamese citizens signed a petition and sent it to the then President, Tran Dai Quang, requesting to review the case, as they believed Ho Duy Hai was innocent.

On October 25, 2019, the Amnesty International’s Secretary-General in Norway, John-Peder Egenæs, have sent a letter to President Nguyen Phu Trong with 25,487 signatures of Norwegian citizens, asking to stop the death penalty with Ho Duy Hai.

On November 22, 2019, the People’s Supreme Procuracy Office petitioned for a cassation trial due to violations as to the investigation and criminal proceedings in Ho Duy Hai’s case. The petition confirmed the “ lacking evidence and violations as stated have directly affected the evidentiary values of the evidence according to the laws, affecting seriously to the conclusion of the defendant’s guilt .” Accordingly, the People’s Supreme Procuracy Office asked the People’s Supreme Court to void both the trial and appellate courts’ decisions.
