Η φυσική ανάγκη του ανθρώπου για ασφάλεια αποτελεί αναφαίρετο δικαίωμα, το οποίο συμβάλλει στην ευρύτερη προσπάθεια του για προφύλαξη από το φυσικό περιβάλλον και τη δυνατότητα ικανοποίησης των αναγκών του. Η θεμελίωση του δικαιώματος της ασφάλειας κατοχυρώθηκε στο άρθρο 3 της Οικουμενικής Διακήρυξης των Δικαιωμάτων του Ανθρώπου (1948), ενώ η σχετική απόφαση της Επιτροπής για την προστασία των Ανθρωπίνων Δικαιωμάτων (1997) πάνω στην αναγκαστική έξωση την χαρακτηρίζει ως “αποτρόπαια παραβίαση των ανθρωπίνων δικαιωμάτων και ειδικά του δικαιώματος της κατάλληλης κατοικίας (right to adequate housing)”.

Το δικαίωμα της στέγης κατέχει θεμελιακή θέση μεταξύ άλλων και στην επιστήμη της ψυχολογίας. Χαρακτηριστικό παράδειγμα η πυραμίδα των ανθρώπινων αναγκών του Abraham Maslow (1954), όπου στη 2η θέση της, μεταξύ των 5 αρχικών επιπέδων της για την πορεία της αυτο-πραγμάτωσης του ανθρώπου, τοποθετούνται οι ανάγκες ασφάλειας, μέσα στις οποίες περιλαμβάνεται και η ανάγκη για στέγη. Είναι χαρακτηριστικό ότι ο Maslow τοποθετεί την ανάγκη αυτή αμέσως μετά τη βάση των ανθρώπινων αναγκών, όπως είναι οι βιολογικές και ψυχοφυσιολογικές ανάγκες του ανθρώπου (η τροφή, το νερό, το σεξ) ενώ θεωρεί απαραίτητη την ολοκλήρωση ενός σταδίου, προκειμένου ο άνθρωπος να περάσει στο επόμενο.

Με την επιβολή των σκληρών μέτρων λιτότητας στις χώρες του Νότου (Ισπανία, Πορτογαλία, Ελλάδα, Ιταλία), η ζωή ενός μεγάλου μέρους των πολιτών πλήττεται βάναυσα. Ένα από τα μέτρα αυτά ήταν και η κατάσχεση κατοικιών, ένα μέτρο το οποίο προκαλεί τεράστιο πλήγμα στον ατομικό ψυχισμό με εμφανείς συνέπειες τόσο στα άτομα που διώχνονται από τα σπίτια τους, όσο και ευρύτερα στην κοινωνία που νιώθει συνεχώς την απειλή αυτή, αλλά και τις συνέπειες της

Είναι χαρακτηριστικό το γεγονός ότι στην Ισπανία, κατά την εφαρμογή αυστηρότατων μέτρων λιτότητας τα οποία εισήγαγε το Μνημόνιο, περίπου 320.000 κατασχέσεις κατοικίας μέχρι το 2013 στέρησαν από τους ανθρώπους το θεμελιώδες δικαίωμα της ασφάλειας δια της στέγης τους. (Barbero, 2015). Το 2014, τουλάχιστον 95 οικογένειες ανά μέρα αναγκάστηκαν να εγκαταλείψουν το σπίτι τους λόγω κατάσχεσης (RT, 2015)
Αυτές οι απάνθρωπες και μαζικές εξώσεις δημιούργησαν μάλιστα και μία νέα κοινωνική ομάδα, η οποία τελεί πλέον υπό καθεστώς έκτακτης ανάγκης: Πρόκειται για τους “desahuciados”, τους νέους άστεγους της χώρας.
Οι desahuciados, αφού αδυνατούν να ανταποκριθούν στις πληρωμές των δόσεων των δανείων τους, χάνουν στη συνέχεια το σπίτι τους μετά από σχετική δίκη και αναγκάζονται, αρκετές φορές και δια της βίας, να πεταχτούν στον δρόμο. Την ίδια στιγμή, το χρέος τους παραμένει, κάτι που τους αποτρέπει από το να ψάξουν για νέα δουλειά με μισθό, έως ότου αποπληρώσουν την οφειλή τους.
Η εκπρόσωπος της πλατφόρμας των ανθρώπων που έχουν πληγεί από αυτά τα φαινόμενα, τόνισε ότι πρόκειται για έναν “αστικό θάνατο, για την ανικανότητα να έχει κανείς μία κοινωνική και δημόσια ζωή” (Colau, 2013: 33).
Το παράδειγμα της Ισπανίας, με τις στατιστικές μελέτες να σοκάρουν, δείχνει το δρόμο που θα ακολουθήσει η υπερψήφιση της διευκόλυνσης των διαδικασιών για την κατάσχεση της πρώτης κατοικίας, μέσω της τροποποίησης του κώδικα πολιτικής δικονομίας. Οι λεγόμενες “βουβές δίκες”, οι οποίες έρχονται, συνίστανται στην επίλυση διαφορών που δεν θα βασίζονται σε καταθέσεις μαρτύρων στο ακροατήριο, αλλά στις ελεγχόμενες και έτσι επισφαλείς ένορκες βεβαιώσεις ενώπιον συμβολαιογράφου. Ταυτόχρονα, οι λεγόμενες εκτελέσεις-εξπρές ευνοούν προκλητικά τις τράπεζες στη διαδικασία των πλειστηριασμών.
Σε μελέτη που έγινε στο Άμστερνταμ, η πρόληψη και η υιοθέτηση μέτρων κατά των εξώσεων βρέθηκε ότι αποτελεί τρόπο παρέμβασης για την προστασία της δημόσιας υγείας, ενώ προτάθηκε η αναφορά της έξωσης ως κοινωνικοοικονομικό πρόβλημα, αλλά και ως πρόβλημα δημόσιας υγείας (Klazinga et al, 2009). Αντί όμως η κυβέρνηση να πάρει μέτρα προστασίας κατά των κατασχέσεων και των εξώσεων, ετοιμάζεται να τις διευκολύνει.

Campaign against evictions in Greece

Why the relevant measures must not be voted on 22nd of Jul y

The human need for safety is an indefeasible right, necessary for the protection from the natural environment and for the fulfillment of broader needs. The right to safety has been constituted with the 3rd article of the Universal Declaration of Human Rights (1948), while the relevant decision of the Commission for Human Rights (1997) renders enforced evictions as ‘abominable violation of human rights and especially of the right to adequate housing’.

The right to adequate housing is also considered as fundamental in the field of psychology. Maslow’s hierarchy of needs (1954) is a representative example; the needs for safety which involve the need for adequate housing are considered as the second most important set of needs within a pyramid of five hierarchical levels of needs, the satisfaction of which is necessary for our personal fulfillment. It is indicative that Maslow sets the need for safety right after the fundamental human biological and psychological needs (e.g. need for food, water, sex etc.) and that he considers personal fulfillment as a staged process that the achievement of each stage presupposes the satisfaction of needs of earlier stages.

The harsh measures of austerity imposed in the countries of the European South (Spain, Portugal, Greece, Italy) have a direct impact on the everyday life of large shares of the population. Forced evictions as one of these measures have severe psychological effects both on the people who are forced to leave their homes and on the society as a whole where the threat of the eviction and its consequences concern everyone.

In Spain, during the implementation of strict measures of austerity imposed by a Memorandum of Understanding, almost 320,000 evictions took place until 2013 depriving even greater numbers of people from their right to safety via the right to adequate housing (Barbero, 2015). In 2014, at least 95 families were forced to leave their houses every day due to the enforced evictions (RT, 2015). These inhumane and massive evictions shaped a new social group, which is now in a state of emergency; the so called ‘desahuciados’, the new category of homeless people in the country. Since desahuciados are unable to pay back their mortgage loans are brought to trial, lose their property rights and at the end are forcefully (sometimes even violently) evicted. At the same time their debt remains and prevents them from searching for a new job with a salary until they repay the debt.
The representative of the platform of people affected by these phenomena stressed that this is a "civil death, the inability to have a social and public life" (Colau, 2013: 33).
The example of Spain, with the shocking statistics, shows what will follow after the vote in favor of facilitating procedures for the confiscation of primary residence, by amending the Code of Civil Procedure. The so-called "silent trials", which are ahead, imply that legal disputes won’t be resolved according to witnesses’ statements in court, but according to controlled and thus ambivalent affidavits before a notary. At the same time, the so-called express executions provocatively favor banks in the process of auctioning.
In a study conducted in Amsterdam, the prevention and the adoption of measures against evictions was found to be an effective way of intervention for the protection of public health, while evictions are considered as a socioeconomic but also as a public health problem (Klazinga et al, 2009 ). However, the government instead of taking protective measures against foreclosures and evictions, is preparing to facilitate them.

For the above reasons
We say NO to forced seizure and eviction.
We say NO to the facilitation of first home foreclosure procedures, to the benefit of banks and other parties.

We call on a variety of actions (information campaign via internet and via social media with the relevant hashtag # ΟΧΙΤοΣπίτιΜου or #StopGREvictions, solidarity demos in consultation with local action committees against auctions, resolutions and demos outside MPs' offices, updates and dissemination of the stories of people threatened with eviction, etc.).

We fight! THE MEASURE WILL NOT PASS!
