A man is set free after sexually assaulting a woman with severe cerebral palsy - it's shocking. But what is truly revolting is how this decision came to be. The Connecticut Supreme Court ruled that Richard Fourtin Jr. be released under the premise that the victim, who is severely disabled, could have physically resisted her attacker by biting or squealing. The woman only has the mental capacity of a three year old and her only method of communication is by moving her right index finger.

Fourtin was not a stranger to the victim, he was aware of her disability and would have known she would not have the ability to properly communicate that she didn't consent to sexual contact. Considering the fact that her mental capacity only reaches that of a three year old makes me wonder if the Supreme Court would hold a three year old responsible for their own sexual assault. She couldn't have known what was happening to her and the fact that they insist that she should have fought back is giving disabled persons more responsibility in stopping attackers than any other person. The Rape, Abuse and Incest National Network (RAINN) states on their website that, "Many victims make the good judgment that physical resistance would cause the attacker to become more violent". So why would a disabled person be held responsible for not fighting back?
