Minister of Justice of Mozambique, Benvinda Levi: Register LAMBDA, the only LGBT rights organization in Mozambique, now!

Mozambique’s LGBT citizens are being denied their right to association. For 7 years, the Minister of Justice, Benvinda Levi, has refused to respond to LAMBDA (The Mozambican Association for Sexual Miniorities) regarding their request for registration as an official NGO - a process that normally takes a maximum of 40 days.

Mozambique is a signatory of the Universal Declaration of Human Rights, of the African Charter on Human and Peoples' Rights, and of the International Covenant on Civil and Political Rights; all of which guarantee the freedom of association.

In February 2011, during the United Nations Periodic Review of Mozambique, the Ministry of Justice affirmed that a) homosexuality did not constitute a crime in Mozambique and b) the Mozambican state did not object to the registration of LGBT organizations.

In November 2013, during the mid-term evaluation of the UPR recommendations, the UN Human Rights Committee expressed its concern over the "prolonged delays in registering "LAMBDA", an NGO defending the rights of homosexuals (arts. 7, 9, 19, 21, and 22)" and recommended "the State party should ensure that decisions on registration of NGOs, including “LAMBDA”, are taken without undue delays."

Still today, Lambda and its members await a decision from the Ministry of Justice concerning their request for registration. This constitutes a grave violation of their constitutional rights. It is urgent that the Mozambican state, specifically the Ministry of Justice, gives Lambda a response concerning their request, and ceases to deny Lambda their legal rights.

The silence of the Minister of Justice legitimizes discrimination and reinforces the stigma which LGBT individuals are subjected to in their communities, workplaces, health care facilities, schools, and more. Above all, it perpetuates the idea that LGBT citizens are inferior citizens.

It is crucial that the Mozambican state recognizes it’s agreement to defend human rights and legitimizes it’s country's sole LGBT rights organization without further delay.

Há 7 anos um grupo de cidadãos remeteu um pedido de reconhecimento jurídico de uma associação de defesa dos direitos LGBT. A Ministra da Justiça, (ministério da Justiça ou Estado moçambicano) Benvinda Levi, tem se mantido em silêncio em relação ao pedido de registo da Lambda como ONG, um processo que normalmente leva o máximo de 40 dias.

Moçambique é signatário da Declaração Universal dos Direitos Humanos, da Carta Africana dos Direitos Humanos e dos Povos, e do Pacto Internacional sobre os Direitos Civis e Políticos, todos os quais garantem a liberdade de associação.

Em Fevereiro de 2011, durante a sessão de perguntas e respostas no âmbito da Revisão Periódica Universal do país, a Ministra da Justiça afirmou que a) a homossexualidade não constituía crime em Moçambique b) o Estado moçambicano não se opunha ao registo de organizações LGBT.

Em Novembro de 2013, durante a avaliação de meio-termo das implementação das recomendações, o Comité Internacional de Direitos Humanos expressou preocupação relativa a "prolongada demora em registar a "LAMBDA", e organizações de defesa dos direitos dos homossexuais (art. 9, 19, 20 21 e 22)" e recomendou que " o Estado assegurasse que os pedidos de registo de ONG, incluindo o da Lambda, fossem respondidos sem demoras".

Até esta data a Lambda e seus membros aguardam uma decisão do Ministério da Justiça em relação ao seu pedido de registo. Isto constitui uma grave violação de direitos constitucionais como o direito a livre associação. É urgente que o Estado moçambicano, em particular o Ministério da Justiça dê uma resposta cumprindo com os ditames legais.

O silêncio do estado Moçambicano, em particular da Ministra da Justiça legitima a discriminação e reforça o estigma que as pessoas LGBT são submetidos em suas comunidades, locais de trabalho, centros de saúde, escolas e muito mais. Acima de tudo, perpetua a ideia de que os cidadãos LGBT são cidadãos inferiores aos demais.

É fundamental que o Estado moçambicano reconheça o dever legal de registar a Lambda para defender os direitos humanos e legitimar a única organização de direitos LGBT do país sem mais demoras.
