Το ελληνικό κράτος με τις διατάξεις του νόμου « Ρυθμίσεις για την Εξυγίανση του Ειδικού Λογαριασμού του Άρθρου 40 Ν.2773/1999 και λοιπές διατάξεις » καταστρατήγησε αναδρομικά τις συμβάσεις που υπέγραψε με πολίτες, μικροεπενδυτές και επιτηδευματίες για την εγκατάσταση φωτοβολταϊκών επί εδάφους και φωτοβολταϊκών στις στέγες μέσω του ειδικού προγράμματος, μη σεβόμενο τις πρόσφατες οδηγίες της Ε.Ε. και τις δημόσιες ανακοινώσεις της Ευρωπαϊκής Επιτροπής Ενέργειας, για μη αναδρομική αλλαγή συμβάσεων με τους επενδυτές.

Οι συμβάσεις αυτές συντάχθηκαν από το ίδιο το Ελληνικό κράτος, χωρίς την παρέμβαση των επενδυτών, στα πλαίσια των δεσμεύσεων που ανέλαβε η χώρα έναντι της Ε.Ε. για την προστασία του κλίματος. Το ν/σ αυτό επιχειρεί μια κραυγαλέα μονόπλευρη διακοπή των υφιστάμενων συμβάσεων 20-ετίας/25-ετίας για την πώληση ηλεκτρικής ενέργειας στούς ΔΙΑΧΕΙΡΙΣΤΕΣ της ενεργειακής αγοράς, (ΛΑΓΗΕ, ΔΕΔΔΗΕ και ΔΕΗ) εισάγοντας αναδρομικά δυσμενείς ρυθμίσεις που αντιβαίνουν πολλαπλές πτυχές όχι μόνο του Ελληνικού Συντάγματος, αλλά και του ευρωπαϊκού και διεθνούς δικαίου. Συγκεκριμένα το Ελληνικό κράτος:

• Ανακοινώνει μεσοσταθμική μείωση 33% της κλειδωμένης τιμής πώλησης (σε πολλές περιπτώσεις η μείωση φτάνει το 50%), κατά παράβαση των συμβάσεων και απειλεί τους παραγωγούς με υποχρεωτική μονομερή αλλαγή αυτών , την ίδια στιγμή που ο ΔΙΑΧΕΙΡΙΣΤΗΣ (ΛΑΓΗΕ, ΔΕΔΔΗΕ και ΔΕΗ) αδυνατεί να εκπληρώσει έγκαιρα τις υποχρεώσεις του προς στους παραγωγούς.
• Υποχρεώνει τους παραγωγούς στην έκδοση εκπτωτικού πιστωτικού τιμολογίου για επιστροφή του 20% - 35% του κύκλου εργασιών από κάθε φωτοβολταϊκή εγκατάσταση του περασμένου έτους (2013), και τους απειλεί με επ’ αόριστο παύση πληρωμών σε περίπτωση μη έκδοσης του , ενώ με παλαιότερες νομοθετικές ρυθμίσεις παρακρατείται ήδη ποσοστό από 25%-42% επί του τζίρου ως έκτακτη εισφορά αλληλεγγύης υπέρ των διαχειριστών (ΛΑΓΗΕ-ΔΕΔΔΗΕ), εισάγοντας τελικά δασμολογικές μειώσεις για το 2013 της τάξης έως και 82% τ ου ετήσιου κύκλου εργασιών ανά φωτοβολταϊκή εγκατάσταση συμπεριλαμβανομένου και της φορολογίας.

Το προτεινόμενο ν/σ, επικαλείται ότι παίρνει τα παραπάνω μέτρα για την προστασία του ειδικού λογαριασμού του ΛΑΓΗΕ και των καταναλωτών από την υπέρογκη αύξηση του Ειδικού Τέλους Μείωσης Εκπομπών Αερίων Ρύπων (ΕΤΜΕΑΡ) που ενσωματώνεται στους λογαριασμούς της ΔΕΗ, την ίδια στιγμή που ΔΕΝ ΑΣΧΟΛΕΙΤΑΙ καθόλου με τις ΧΡΟΝΙΕΣ ΣΤΡΕΒΛΩΣΕΙΣ στην αγορά ενέργειας που συνεχίζουν να ΕΠΙΔΟΤΟΥΝ τα ΟΡΥΚΤΑ ΚΑΥΣΙΜΑ και το ΦΥΣΙΚΟ ΑΕΡΙΟ (Νόμος 4001/2011, άρθρο 197, παρ. 2), και ευνοούν τη ΣΥΣΣΩΡΕΥΣΗ ΥΠΕΡΚΕΡΔΩΝ για τους ΠΡΟΜΗΘΕΥΤΕΣ ηλεκτρικής ενέργειας και τη ΔΕΗ.

Η παράλογη νομοθεσία της ελληνικής κυβέρνησης που ψηφίσθηκε πρόσφατα κρατικοποιεί έμμεσα χιλιάδες μικροεπιχειρήσεις ΑΠΕ που λειτουργούν νόμιμα στην Ελλάδα αναγκάζοντας 55 χιλιάδες συμπολίτες μας και μικροεπιχειρήσεις να κηρύξουν πτώχευση λόγω αδυναμίας πληρωμής δανείων και φόρων, σε μια δύσκολη οικονομική συγκυρία, που για αρκετούς και τις οικογένειές τους ήταν η μοναδική πηγή συμπλήρωσης του ήδη μειωμένου εισοδήματος τους από μισθούς , συντάξεις κ.ά.

Με το παρόν νόμο, ανοίγει διάπλατα ο δρόμος για κατάργηση, μονομερώς, κάθε σύμβασης και θα προκύψει αθέτηση πληρωμών και για άλλους τομείς της οικονομίας στο μέλλον.

Το Ελληνικό κράτος και ο Υφ. Π.Ε.Κ.Α. ΕΞΑΠΑΤΩΝΤΑΣ ΤΟΝ ΕΛΛΗΝΙΚΟ ΛΑΟ, ΕΚΒΙΑΣΕ τους ΒΟΥΛΕΥΤΕΣ να ψηφίσουν τον επαχθή νόμο που καταστρατηγεί τις συμβάσεις και κάθε έννοια προστασίας των πολιτών και μικροεπενδυτών, με το ΔΙΛΗΜΜΑ της αύξησης κατά 125% του ΕΤΜΕΑΡ που θα βαρύνει τους καταναλωτές.

SUPPORT THE GREEK PV PRODUCERS FROM THE UNILATERAL CONTRACT BREACH WITH THE STATE

The Greek state with the Law «Arrangements for reforming the Special Account L.2773/1999 Article 40 and other provisions», circumvents the signed contracts with the citizens, the small investors and the professionals to install solar PV on ground and on rooftops through a specific program, not respecting the recent EU directives and the public announcements of the Energy European Committee for avoiding retroactive contract amendments with the investors.

These contracts were compiled by the Greek state itself, without the intervention of investors in the context of the country’s EU commitments for climate protection. This draft law attempts an abusive and unilateral termination of signed contracts 20/25years for supply electricity to the Greek operators of electricity market (LAGIE, DEDDHE and DEH) by imposing retroactive adverse ordinances, which contravene multiple aspects of the Greek Constitution and the European and international law. In particular the Greek state:

• Announces unilateral weighted average reduction up to 33% over the locked feed in tariff (and in many cases up to 50%) in breach of contract, blackmailing the producers with compulsory unilateral contract amendment. At the same time the operator of electricity market (LAGHE, DEDDHE and DEH) is unable to accomplish its obligations towards the producers according to the contract's provisions.
• Compels the electricity producers to issue a credit invoice for mandatory haircut ranging from 20% - 37.5% of the PV investment turnover concerned the last year (2013), blackmailing them with indefinite payments suspension, while earlier ministerial decrees have imposed a solidarity special levy in percentage of 25% -42% of the annual turnover towards the operator of electricity market (LAGIE - DEDDHE) introducing tariff reductions up to 82% in total of the annual turnover per PV investment including the related taxation.

The proposed draft law invokes to take the aforementioned measures towards the protection of the special account of LAGIE and consumers from excessive increase of the Special Levy for Reduction of Greenhouse Gases incorporated in the electricity bills. At the same time this draft law does not deal with the PERMANENT DISTORTIONS of the energy market at all and continues to subsidize fossil fuels and natural gas (Law 4001/2011, Article 197, paragraph 2), and to favor the accumulation of excessive profits to the electricity market suppliers and PPC.

The outrageous legislation of the Greek government, which nationalizes indirectly thousands of SMEs operating legally on Renewables market in Greece, forces 50 thousands of our fellow citizens to declare bankruptcy due to defaulting loans and taxes in a difficult economic environment where the only income for some of them and their families, which have already suffered the unexpected and sudden reduction on their salaries and pensions, is.

By this Lawt, the unilateral abolition of every contract is possible, resulting in payment default even for other sectors of economy in the near future.

The Greek state and the Deputy Minister of Energy, Environment and Climate, deciving the Greek citizens, blackmailed the Members of Greek Parliament to vote the onerous draft law, which violates the contracts and any sense of right and protection of citizens and small investors by pretending an increase of ETMEAR up to 125% to bear the consumers.

REQUEST

THE IMMEDIATE CANCELLATION of the abortional LAW which circumvents unilaterally and coercively the CONTRACTS of thousands of the Greek CITIZENS revealing directly issues of morality, democracy, European Law & Human Rights (ECHR) as contrary to its basic principles.
