In the United States v. BNP Paribas S.A. (BNPP) case, a money judgement in the amount of $8,833,600,000.00 entered against BNPP. As more than 70 percent of BNPP's illegal transactions involved Sudan, Sudan Human Rights
Network (SHRN), a non-profit organization based in Washington, D.C., calls on the U.S. Department of Justice to use a significant portion of the forfeited funds to establish a Humanitarian Trust Fund for internally displaced persons (IDPs) in Sudan, and Sudanese in refugee camps, as it would be the most effective way to compensate individuals harmed by the sanctioned regime of Sudan and the BNPP’s criminal conduct.

في القضية المعروفة ب "الولايات المتحدة ضد بي اِن بي باريباس(بي اِن بي بي)"، صدر حكم بتغريم بي اِن بي بي مبلغ وقدره 8.833.600.000دولار أمريكي (حوالي تسعة مليارات). وبما أن حكومة السودان طرف أساسي في أكثر من سبعين بالمائة من المعاملات غير القانونية لبنك بي اِن بي بي، فإن الشبكة السودانية لحقوق الانسان، والتي مقرها العاصمة واشنطن دي سي، تدعو وزارة العدل الأمريكية استخدام جزء مقدر من الغرامة المتحصلة لتأسيس صندوق لمواجهة الاحتياجات الانسانية للنازحين داخل السودان وللسودانيين في معسكرات اللجوء، كأفضل وسيلة لتعويض المتضررين من التصرف الاجرامي لبنك بي اِن بي بي وممارسات السلطة الحاكمة في السودان المفروض عليها عقوبات المقاطعة الاقتصادية.

In July 2014, BNP Paribas S.A. (BNPP), a bank headquartered in Paris, pled guilty to conspiring to violate the International Emergency Economic Powers (IEEPA) and the Trading with the Enemy Act (TWEA) by processing billions of dollars of transactions through the U.S. financial system on behalf of Sudanese, Iranian, and Cuban entities subject to U.S. economic sanctions.

في يوليو 2014، أقر بنك بي اِن بي بي، والذي مقره الرئيسي في باريس، بمسؤوليته في خرق قانون الصلاحيات الاقتصادية في حالات الطوارئ الدولية، وقانون الاتجار مع العدو، حيث تم تمرير مليارات الدولارات عبر النظام المالي الأمريكي بالإنابة عن مؤسسات سودانية وإيرانية وكوبية خاضعة لقانون المقاطعة الاقتصادية الأمريكية. لقد تمّ التحقيق في هذه القضية بواسطة المكتب الميدانيلجرائم الضرائب في واشنطن، ومكتب التحقيقات الفدرالية الميداني في نيويورك.

This case was investigated by the IRS-Criminal Investigation’s Washington Field Division and the FBI’s New York Field Office. The case is being prosecuted by the Money Laundering and Bank Integrity Unit of the Criminal Division’s Asset Forfeiture and Money Laundering Section (AFMLS), and the Money Laundering and Asset Forfeiture Unit of the U.S. Attorney’s Office for the Southern District of New York.

According to documents released publicly, including a detailed statement of facts admitted to by BNPP, BNPP has acknowledged that, from at least 2004 through 2012, it knowingly and willfully moved over $8.8 billion through the U.S. financial system on behalf of Sudanese, Iranian and Cuban sanctioned entities, in violation of U.S. economic sanctions. The majority of illegal payments were made on behalf of sanctioned entities in Sudan, which was subject to U.S. embargo based on the Sudanese government’s role in facilitating terrorism and committing human rights abuses. From July 2006 through June 2007, BNPP processed approximately $6.4 billion through the United States on behalf of Sudanese sanctioned entities, including approximately $4 billion on behalf of a financial institution owned by the government of Sudan.

طبقاً للوثائق المتاحة للعامة، الشاملة للحقائق المفصلة التي أقر بها بنك بي اِن بي بي، على الأقل في الفترة بين عام 2004 إلى 2012، أتاح البنك بمعرفته التامة عملية نقل أموال تقدر بحوالي 8.8 مليار دولار أمريكي عبر النظام المالي الأمريكي، نيابةً عن مؤسسات سودانية وإيرانية وكوبية خاضعة لقانون المقاطعة الاقتصادية الأمريكية. معظم هذه التعاملات كانت بالإنابة عن مؤسسات سودانية خاضعة للمقاطعة الاقتصادية الأمريكية تأسيساً على دور السلطة الحاكمة في السودان في دعم الارهاب وانتهاكاتها لحقوق الإنسان. من يوليو 2006 إلى يونيو2007، نقل بنك بي اِن بي بي إلى النظام المالي الأمريكي حوالي 6.4 مليار دولار لمؤسسات سودانية مقاطعة، منها حوالي 4 مليارات دولار تخص مؤسسات تعود ملكيتها بصورة مباشرة للحكومة السودانية.

Millions of Sudanese harmed by BNPP’s criminal conduct, both those that remain in Sudan and those who were forced into refugee camps in neighboring countries, live in terrible conditions. Payment of collective reparations to communities harmed by BNPP’s criminal conduct would mitigate the harms inflicted by the Sudan regime more effectively than can be accomplished by paying individual claims. The distribution of money should go to war-torn areas to fund humanitarian projects.

الملايين من السودانيين تضرروا من تصرف بنك بي اِن بي بي الاجرامي، سواءهؤلاء الذين يعيشون في السودان، أو أولئك الذين أُجبروا إلى معسكرات اللجوء في دول الجوار، كلهم يعيشون في ظروف بالغة القسوة. بدلاً عن الاتجاه لدفع تعويضات للمطالبات الفردية، فإن دفع تعويضات للمجتمعات التي تضررت جراء تصرف بنك بي اِن بي بي، تساهم بفعالية أكثر في تخفيف الضرر الذي أحدثته السلطة الحاكمة في السودان. دفع التعويضات يجب أن يذهب إلى المناطق التي مزقتها الحرب بهدف تمويل مشروعات الاغاثة الإنسانية.

The UN Refugee Agency (UNHCR) statistical report indicate that there are 2,192,830 Internally Displaced Persons and 665,954 refugees as of December 2014. Displaced persons in war-affected areas face one of the worst humanitarian crises in the world. They urgently require food, water, shelter, and other basic needs. Establishing a Humanitarian Trust Fund for the displaced aims towards addressing funding these critical needs, and that is where the BNPP settlement money should go.

تشير إحصاءات مفوضية شؤون اللاجئين التابعة للأمم المتحدة في نهاية ديسمبر عام 2014، إلى أن عدد النازحين داخلياً في السودان بلغ 2,192,380 بينما بلغ عدد السودانيين في معسكرات اللجوء 665,954 لاجئ. يواجه النازحون في المناطق التي مزقتها الحرب واحدة من أسوأ الكوارث الإنسانية في العالم. يحتاجون بصورة عاجلة إلى الماء والغذاء والمأوى وبعض ضروريات الحياة الأساسية الأخرى. عليه يصبح تأسيس صندوق استئماني للعون الإنساني للنازحين، يهدف إلى معالجة تمويل تلك الاحتياجات الحرجة، هو ما يجب أن تذهب إليه عائدات التسوية مع بنك بي اِن بي بي.

SHRN urges the U.S. Department of Justice to establish a Humanitarian Trust Fund for internally displaced people (IDPs) in Sudan, and Sudanese in refugee camps in neighboring countries to assist the most vulnerable communities of displaced people affected by war in Darfur, South Kordofan, and South Blue Nile. The Humanitarian Trust Fund should support national NGOs, international NGOs, and UN agencies providing humanitarian assistance to people in need in a strategic and timely manner.

الشبكة السودانية لحقوق الانسان تحث وزارة العدل الأمريكية على تأسيس صندوق استئماني لتقديم العون الإنساني للنازحين داخل السودان، وللاجئين في معسكرات اللجوء في دول الجوار لمساعدة مجتمعات النازحين المستضعفة بسبب الحرب في دارفور وجنوب كردفان وجنوب النيل الأزرق. صندوق الاستئمان لتقديم العون الإنساني يجب أن يدعم تمويل المنظمات غير الحكومية المحلية، والمنظمات غير الحكومية العالمية، ومؤسسات الأمم المتحدة التي تعمل في مجال تقديم المساعدات الإنسانية الاستراتيجية العاجلة للسكان للمحتاجين في السودان.
