Pronunciamiento contra la represión y violación de derechos humanos en el Perú

Las ciudadanas y ciudadanos peruanos, con el apoyo solidario de ciudadanos austriacos y de otras nacionalidades residentes en Austria abajo firmantes, nos manifestamos frente a los graves atentados contra los derechos humanos producto de la violenta represión contra la población peruana que desde 7 diciembre del 2022 realiza el gobierno de Dina Boluarte con la complicidad de la mayoría del Congreso. En este contexto, expresamos lo siguiente:

1. Nos solidarizamos con el legítimo derecho a la protesta pacífica de la población peruana y con el profundo dolor de los familiares de las personas asesinadas.
2. Condenamos el uso desproporcionado de la fuerza por parte de la Policía Nacional y las Fuerzas Armadas, que desde el inicio de las protestas sociales están violando sistemáticamente los derechos humanos de la población civil. Entre estos actos se cuentan el haber ocasionado la muerte de más de medio centenar de personas, configurándose en muchos casos, crímenes de lesa humanidad.
3. Como bien ha señalado la Comisión Interamericana de Derechos Humanos, el uso excepcional de la fuerza pública debe basarse en los principios de legalidad, absoluta necesidad y proporcionalidad, principios que evidentemente el gobierno del Perú no está respetando.
4. Denunciamos que el gobierno de Dina Boluarte está cambiando la narrativa y los hechos, trasladando la responsabilidad de las muertes a quienes protestan, aun cuando los vídeos y las pericias correspondientes han demostrado que las personas fueron asesinadas por armas de uso policial y militar.
5. Denunciamos que la represión del Estado ha causado centenares de heridos y violado otros derechos fundamentales como ha sucedido en el Campus de la Universidad Nacional Mayor de San Marcos. En esta intervención policial se detuvieron 193 personas, incluyendo líderes estudiantiles, una mujer embarazada, menores de edad, personas indígenas y de la tercera edad, así como cuatro periodistas. Durante y después de las detenciones dichas personas fueron agredidas verbalmente con insultos racistas e intimidatorios y algunas mujeres sufrieron agresiones sexuales. De igual manera se denunciaron violaciones al debido proceso como la obstrucción a la defensa legal y la falta de traductores en idiomas originarios como el quechua, aymara y otros para la comprensión de las acusaciones y la defensa de los detenidos. Todas las personas fueron liberadas por no existir pruebas de haber cometido delito.
6. Denunciamos la actitud de la mayoría de congresistas (que no tienen ni el 9% de aprobación popular) que se niegan a buscar una salida a esta crisis, acorde con el justo reclamo de la mayoría de la población peruana.
7. Exigimos a las autoridades competentes a llevar a cabo una investigación profunda a fin de determinar la responsabilidad de los autores intelectuales y ejecutores de los asesinatos en las protestas.
8. Solicitamos la mediación de organizaciones internacionales como la OEA, ONU y la Unión Europea a fin de encontrar una solución pacífica y democrática a la crisis que atraviesa el Perú.
9. Los asesinatos y otros actos violatorios de los derechos humanos deslegitiman al gobierno de Dina Boluarte y a su primer ministro Alberto Otárola, haciendo insostenible su continuidad en el cargo de presidenta del Perú.
10. Nos solidarizamos con el Pueblo Peruano que exige el cese de la violencia militar y policial, la renuncia de Dina Boluarte a la Presidencia del Perú, la elección de una nueva Mesa Directiva en el Congreso de la República, la convocatoria inmediata a elecciones generales para el año 2023 y a un referéndum sobre la Asamblea Constituyente.

Unterstützen Sie mit Ihrer Unterschrift die Erklärung gegen Repression und Verletzung der Menschenrechte in Peru  unter der Regierung von Dina Boluarte  
Die UnterzeichnerInnen dieser Erklärung, peruanische StaatsbürgerInnen, sowie ÖsterreicherInnen, EuropäerInnen und BürgerInnen anderer Nationalitäten mit Wohnsitz in Österreich, protestieren angesichts der schweren Menschenrechtsverletzungen im Gefolge der gewaltsamen Unterdrückung der peruanischen Bevölkerung, die seit dem 7. Dezember 2022 von Seiten der peruanischen Regierung Dina Boluartes, in Komplizenschaft mit der Mehrheit des Kongresses (Parlament) stattfinden. In diesem Zusammenhang geben wir folgende Erklärung ab:

1. Wir solidarisieren uns mit dem legitimen Recht des peruanischen Volkes auf friedlichen Protest und mit dem tiefen Schmerz der Familienangehörigen der ermordeten Menschen.
2. Wir verurteilen die unverhältnismäßige Anwendung von Gewalt durch die Nationale Polizei und die Armee, die seit Beginn der sozialen Proteste systematisch die Menschenrechte der Zivilbevölkerung verletzen. Zu diesen Vorgängen gehören u. a. der Tod von mehr als 50 Menschen, die in vielen Fällen als Verbrechen gegen die Menschlichkeit bezeichnet werden müssen.
3. Wie die Interamerikanische Kommission für Menschenrechte richtig festgestellt hat, darf außergewöhnliche Anwendung staatlicher Gewalt nur auf rechtsstaatlicher Grundlage und unter Einhaltung des Verhältnismäßigkeitsprinzips erfolgen. Beides wird von der peruanischen Regierung offensichtlich nicht respektiert.
4. Wir verurteilen, dass die Regierung von Dina Boluarte die Erzählung und die Fakten verdreht, indem sie die Verantwortung für den Tod auf die Demonstranten schiebt, obwohl die Videoaufzeichnungen und forensische Untersuchungen gezeigt haben, dass die Opfer durch Waffen von Polizei und Militär ermordet wurden.
5. Wir verurteilen, dass die staatliche Repression Hunderte von Verletzten zur Folge hatte und dass auch andere fundamentale Rechte verletzt wurden, wie beispielsweise bei der Erstürmung des Campus der Universität Mayor de San Marcos. Bei diesem Polizeieinsatz wurden 193 Personen festgenommen, darunter Studentenvertreter, eine schwangere Frau, Minderjährige, Indigene und alte Menschen sowie vier Journalisten. Während und nach der Festnahme wurden diese Personen aggressiv beschimpft, durch rassistische Beleidigungen und verbale Bedrohungen eingeschüchtert und einige Frauen waren sexuellen Übergriffen ausgesetzt. Es wurden zudem Verstöße gegen ein ordentliches, rechtsstaatliches Verfahren gemeldet, wie zum Beispiel die Behinderung von Anwälten zur Verteidigung und das Fehlen von Übersetzern in Original- und Amtssprachen wie Quechua, Aymara und andere, die nötig gewesen wären, um die Anschuldigungen zu verstehen und die Inhaftierten zu verteidigen. Alle Personen mussten freigelassen werden, weil ihnen keine Ausübung von Delikten nachgewiesen werden konnte.
6. Wir verurteilen die Haltung der Mehrheit der Kongressabgeordneten (die, laut Meinungsumfragen, nicht einmal die Zustimmung von 9% der Bevölkerung erhalten) und die sich weigern, einen Ausweg aus dieser Krise zu suchen, der den gerechten Forderungen der Mehrheit der peruanischen Bevölkerung entspricht.
7. Wir fordern von den zuständigen Behörden eine gründliche Untersuchung, um die Befehlsgeber und die ausführenden Täter der Ermordung der Demonstranten zur Verantwortung zu ziehen.
8. Wir ersuchen um Mediation durch internationale Organisationen wie die Organisation Amerikanischer Staaten, die UNO und die Europäische Union, mit dem Ziel, eine friedliche und demokratische Lösung der Krise, die Perú derzeit durchmacht, zu erreichen.
9. Die Morde und andere Menschenrechtsverletzungen delegitimieren die Regierung Dina Boluarte und ihren Ministerpräsidenten Alberto Otárola und machen eine weitere Ausübung ihrer Ämter unmöglich.
10. Wir fordern das sofortige Ende der militärischen und polizeilichen Gewalt, den Rücktritt Dina Boluartes als Präsidentin Perus, die Wahl eines neuen Vorstandes des peruanischen Kongresses (Parlament), die sofortige Ausrufung von Parlamentswahlen noch im Jahr 2023 und eines Referendums für eine Konstituierende Versammlung zur Ausarbeitung einer neuen Verfassung.

We, the undersigned Peruvian citizens, with the solidarity support of Austrian citizens and citizens of other nationalities residing in Austria, declare ourselves against the serious violations of human rights resulting from the violent repression against the Peruvian population that since December 7, 2022 has been carried out by the government of Dina Boluarte with the complicity of the majority of the Congress. In this context, we express the following:  

1. We stand in solidarity with the legitimate right to peaceful protest of the Peruvian population and with the deep pain of the relatives of the murdered people.
2. We condemn the disproportionate use of force by the National Police and the Armed Forces, which since the beginning of the social protests have systematically violated the human rights of the civilian population. These acts include the death of more than fifty people, in many cases constituting crimes against humanity.
3. As the Inter-American Commission on Human Rights has pointed out, the exceptional use of public force must be based on the principles of legality, absolute necessity and proportionality, principles that the Peruvian government is evidently not respecting.
4. We denounce that the government of Dina Boluarte is changing the narrative and the facts, shifting the responsibility for the deaths to those who protest, even when the videos and the corresponding expert reports have shown that the people were killed by police and military weapons.
5. We denounce that the State repression has caused hundreds of wounded and violated other fundamental rights, as has happened on the campus of the Universidad Nacional Mayor de San Marcos. In this police intervention 193 people were arrested, including student leaders, a pregnant woman, minors, indigenous and elderly people, as well as four journalists. During and after the arrests, these people were verbally assaulted with racist and intimidating insults and some women were sexually assaulted. Violations of due process were also denounced, such as the obstruction of legal defense and the lack of translators in native languages such as Quechua, Aymara and others to understand the accusations and the defense of the detainees. All the people were released for lack of evidence of having committed a crime.
6. We denounce the attitude of the majority of congressmen (who do not even have 9% of popular approval) who refuse to seek a solution to this crisis, in accordance with the just demands of the majority of the Peruvian population.
7. We demand that the competent authorities carry out a thorough investigation in order to determine the responsibility of the intellectual authors and executors of the murders in the protests.
8. We request the mediation of international organizations such as the OAS, UN and the European Union in order to find a peaceful and democratic solution to the crisis in Peru.
9. The assassinations and other acts of human rights violations delegitimize the government of Dina Boluarte and her Prime Minister Alberto Otarola, making her continuity as President of Peru untenable.
10. We stand in solidarity with the Peruvian people who demand the cessation of military and police violence, the resignation of Dina Boluarte as President of Peru, the election of a new Board of Directors in the Congress of the Republic, the immediate convocation of general elections for the year 2023 and a referendum on the Constituent Assembly.
