The Labour Court recently awarded homosexual fathers 4 months maternity leave benefits when they have a child through surrogacy. This Landmark case strengthens the argument for heterosexual fathers' right to sufficient Paternity Leave.

At present South African men are only entitled to 3 days Family Responsibility Leave annually, which is insufficient and unfair when taking the best interest of the child into consideration. Recent studies indicate that South African households are increasingly sharing responsibilities equally between partners and these responsibilities should include care for newborn babies.

What are the Benefits of Paternity Leave ?
In countries that provide sufficient paternity leave to fathers, studies have found that women not only recover faster from the physical stress of child birth, but also return to their employment more revitalised. The fathers and children benefit too, as paternity leave allows for stronger bonds to form from the outset, ensuring better relationships and development in the long term.

How Parental Leave differs around the world:
Sweden: Provides 480 days leave, with 60 days exclusively reserved for each parent. The balance is pooled and shared as the parents choose.
UK: 12 months leave shared between parents. Women must take the first 2 weeks, but the balance can be transferred to the father. Kenya: 14 Days Paternity Leave provided to fathers
Cameroon, Chad, Gabon, Cote D’Ivore: 10 Days Paternity Leave provided to fathers


We Need your Support!
The time has come for Employment Laws to be changed to correspond to the social norms and international practices that accept that parenting is not an act reserved only for women. The decision of which parent should care for a newborn, should be placed in the hands of the parents, in the best interest of the child.

We ask your support and request that you sign this petition, which we will present to key role players in our legislature for consideration. The ACDP has created a Draft Bill, which will be presented to Parliament in due course, whereafter the Bill will be subject to commentary. We will actively participate at this stage to help ensure that the final Bill provides sufficient leave, places more choice in the hands of parents, is in line with international practices and upholds our Constitutional Rights.
