ABOUT THE CASE
Indira Gandhi married her husband Patmanathan in 1993 and they have 3 children. On 11th March 2009, the husband converted to Islam. On 2nd April 2009 their three children were converted into Islam by the husband. Please bear in mind that this conversion is without the consent or knowledge of his wife. The family was separated and K. Patmanathan took the children and went into hiding.

Can a Syariah Court have exclusive jurisdiction over a hindu child? What happened? In 2009, the Ipoh Syariah High Court gave Muhd Riduan custody of Tevi Darsiny, 12, Karan Dinish, 11, and Prasana Diksa months. The three children are now aged 18,17 and 7 . The Ipoh Civil Court on the other hand had declared the custody null and void after a judicial application was made by the Hindu biological mother . She (Indira Gandhi) and the former husband K. Patmanathan (Muhd.Riduan Abdullah) were practising Hindus and their three children were Hindus at birth.
The issue was argued whether the Civil High Court had the jurisdiction to hear the conversion case and over the High Court's decision on quashing the certificate of conversion. Why not? Indira Gandhi and her three children are born practising Hindus. Why she and her children must go to Syariah court? Her marriage was solemnised in a Hindu temple according to Hindu rites. She is entitled to a civil law not Syariah law.
Chronology of Court Cases.
9th June 2009, Indira file for Judicial review at the Ipoh High Court to quash the issuance of Certificate of Conversion to Islam by Jabatan Agama Islam Perak, Malaysia.
28th July 2010, the Ipoh Civil High Court gave leave to quash the issuance of Certificate of Conversion to Islam.
25th July 2013 Ipoh High Court gave an order to quash 3 Certificate of Conversion issued by the Jabatan Agama Islam Perak ( Perak Islamic Department) and the certificate are null and void and of no legal effect. It was also declared that the children have not been converted in accordance to the law.
From this decision,
26th July 2015, 6 respondents have appealed to the Court of Appeal . Case is still ongoing. We are appealing to online readers to sign a petition so that Islamic rule must not used on non-Muslims.
The federal constitution in article 11 says that every person has the right to profess and practise his own religion. The state law in respect of the federal law however restricts or control the propagation of any religious doctrine among Malays (Muslims). In other words non Muslims cannot propagate their religious belief to the Muslims in Malaysia. Having said that, however the Muslims are allowed and encouraged to profess and propagate his belief on non-Muslims.
Not only the law restricts us, the Muslims themselves often taut and mock other religions. They use anger and intimidation to provoke the non-Muslims. The authority seldom on our side. Even if they do, that is often after much public uproar. Even small things like hanging banners out the house of worship can trigger Muslim demonstrations.
We almost cannot build any more houses of worship, because the town council will tear in down without pity or respect. Many old temples have been demolished and all the deities trampled upon. Missionary works among the non-Muslims are also eyed with suspicion and warnings. The restrictions of Bahasa Malaysia for religious writings is one way of restricting the growth of other religion in Malaysia.
Religious teachers are being sent to remote schools to convert school children to Islam without the knowledge of their poor parents. Children are made fun of , mocked and side lined for being non-Muslims. Our kid are told to kiss teacher's feat because he wore vibuthi on this forehead.
We can go on and on, the atrocities of the ruling party and they officials must be put to stop. We deserve the due respects.
Being the loyal citizen of the country, we must be allowed to practice our religion and traditions without fear or prejudice. We have toiled the lands. Our forefathers sacrificed everything to come here and build a home. Many of us do not have ties with our country of origin because this is our land. This is where we earn and contribute our wealth.
A judge should not be biased in his judgement. This is detrimental to the country's peace and security. It is an act of coward to have a Muslim judge to hear a case of illegal conversion . Judges should come from all faith for a fair hearing.
Most importantly we must not have a syariah law implemented on non-Muslims. A fight of Madam Indira is a fight for freedom to practice ones own religion. It is also a fight against unwilling conversion of minors.
On moral grounds, Madam Indira Gandhi's youngest daughter was only 11 months old baby when her husband took her away from her mother. The baby was believed to have been surrendered to a Muslim couple in a remote area in Malaysia. How the child would have missed the warmth of a mother's bosom. A mother's pang for her daughter. She never gave up till today, she is climbing the stairs to the court in hope to hear good news.
Let us be the catalyst, for her to have the good news. Please sign the petition and free Indira Gandhi's children from the clutches of this unfair law. It will not only be her victory but for all of us, the constantly oppressed non-Muslims.
Message to Malaysian King and State Rulers
It is an act of cowardice to have a judge who is a Muslim to hear the case of illegal Islamic child conversion. If the government is brave enough they should appoint one Hindu judge, one Christian judge, one Buddhist judge and 2 Malay judges. This is a typical act of cowardice which is repeated in many of the conversion cases. We cannot tolerate this anymore. We hold UMNO the Rulers for all the illegal conversion in Malaysia.
Indira Gandhi's case is not a remote case in Malaysia. We want justice for the case and the rulers should be impartial to interfere in this case immediately. Today you may make many Hindu mothers cry and feel superior. There will be a downfall and at that day many of the majorities will cry. In every chart there are ups and downs. You cannot be on top all of the time. We call the rulers and Malay politicians urgently stop this nonsense. Otherwise give us chance to preach to Malays.
We (Hindus, Buddhist, Christians, Sikhs, Tao and etc) do not agree with 60 years old outdated Federal Constitution which is saying Muslims can preach to other religious people but other religious people cannot preach to Muslims. If Islam is the strongest religion on earth, abolish the coward laws which are not relevant any more nowadays. The law was most probably agreed by majority UMNO, MCA and MIC. Today MCA and MIC do not represent the Chinese and Indians. We do not consider them as part of our community. They are merely corrupted partners of UMNO. When MCA and MIC do not represent the community, the law which agreed is not applicable for a developed nation. STOP the conversion of Non-Muslim to Islam, otherwise let the law be equal to everyone. Do not have (syok sendiri) one-sided conversion which favour one race. Non-Muslims are not making trouble in this country but the country has full of outdated laws and suppressing laws.
There will be many such uncivilized kings ruling at the same time, O King Parīkṣit, and they will all be uncharitable, possessed of fierce tempers, and great devotees of irreligion and falsity. (SB 12.1.38)
The citizens governed by these low-class kings will imitate the character, behaviour and speech of their rulers. Harassed by their leaders and by each other, they will all suffer ruination. (SB 12.1.41)
The kings will mostly be thieves, the occupations of men will be stealing, lying and needless violence, and all the social classes will be reduced to the lowest.(SB12.2.12-16)
Those quotation stem from Hindu religion which state how the politicians and rulers in this age will be. The question is, if Hindu religion is wrong in their prediction then Islam must show how it is wrong, otherwise it should be the other way around.
We, finally appeal to the Rulers commission to do the political correction to protect the Non-Muslims which is the Rulers duty to protect their subjects.
