To the public, and to the conscience of justice,
We are following with deep concern the case of artist and filmmaker El Mahdi Lyoubi, professionally known as Mehdi Black Wind, who has been detained at Okacha Prison since 13 July 2026 in connection with charges of insulting a constitutionally established institution.
This case concerns far more than El Mahdi Lyoubi alone. It raises fundamental questions about respect for the rule of law, including the presumption of innocence, the guarantees of a fair trial, and the freedom of artistic creation and expression.
These rights are protected under Article 25 of the Moroccan Constitution, Article 19 of the Universal Declaration of Human Rights, which guarantees the right to freedom of opinion and expression, and the International Covenant on Economic, Social and Cultural Rights, which affirms the right to freely participate in cultural life.
El Mahdi Lyoubi has remained in pre-trial detention, while the hearing of his case has been postponed until 22 July 2026. This decision was taken despite the absence of his legal counsel, who were participating in a legitimate nationwide lawyers' strike, raising serious concerns about his right to legal representation and the guarantees of a fair trial.
Furthermore, El Mahdi Lyoubi meets every legal and professional condition that would justify his release pending trial. He legally resides in Marseille, has an established artistic and professional career, and presents no risk to the course of the investigation or the judicial proceedings.
Pre-trial detention should remain an exceptional measure. The presumption of innocence, as a universal and fundamental principle, must remain the rule until a final and legally binding judgment is issued.
In light of the above, we call for :

نتابع بقلق بالغ قضية الفنان والمخرج المهدي اليوبي، المعروف فنيا باسم مهدي بلاك ويند والمعتقل بسجن عكاشة منذ 13 يوليوز 2026، على خلفية متابعته بتهمة إهانة هيئة دستورية
إن هذه القضية لا تخص المهدي اليوبي وحده، بل تهم أيضا احترام المبادئ الأساسية لدولة الحق والقانون، وفي مقدمتها قرينة البراءة، وضمانات المحاكمة العادلة، وحرية الإبداع والتعبير، المكفولة دستوريا بموجب الفصل 25 من الدستور، والمادة 19 من الإعلان العالمي لحقوق الإنسان، الضامنة لحرية الرأي والتعبير، والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، الذي يؤكد ضرورة احترام حرية النشاط الثقافي
وقد تم الإبقاء على الفنان المهدي اليوبي رهن الاعتقال الاحتياطي، مع تأجيل النظر في ملفه إلى جلسة 22 يوليوز 2026، في ظل غياب هيئة دفاعه بسبب خوضها إضرابا مهنيا مشروعا، وهو ما يثير مخاوف جدية بشأن ضمان حقه في الدفاع واحترام شروط المحاكمة العادلة
كما أن المهدي اليوبي يتوفر على كافة الضمانات القانونية والمهنية التي تبرر متابعته في حالة سراح، إذ يقيم بشكل قانوني بمدينة مارسيليا، وله مسار فني ومهني معروف، ولا يشكل أي خطر على سير العدالة أو على إجراءات التحقيق والمحاكمة
وعليه، فإن الاعتقال الاحتياطي يظل إجراء استثنائيا، بينما تبقى قرينة البراءة، باعتبارها مبدأ كونيا وأساسيا، هي الأصل إلى حين صدور حكم قضائي نهائي مكتسب لقوة الشيء المقضي به
وانطلاقا من كل ما سبق، فإننا نطالب بما يلي
أولاً. الإفراج الفوري عن فنان الراب والمخرج المهدي اليوبي، المعروف فنيا باسم مهدي بلاك ويند، أو على الأقل تمتيعه بالسراح المؤقت إلى حين استكمال جميع مراحل التقاضي
ثانيًا. وقف متابعة فناني الراب بشكل خاص، والفنانين عموما، بسبب آرائهم ومواقفهم وإبداعاتهم الفنية، واحترام حرية الإبداع والتعبير وخصوصية فن الراب، وصون حقوق الفنانين كما يكفلها الدستور والقانون والتزامات المغرب الدولية المتعلقة بحرية الرأي والتعبير والنشاط الثقافي
ثالثًا. الإسراع بإخراج إطار قانوني يحمي الفنانين، ويمنع اللجوء إلى العقوبات السالبة للحرية بسبب الآراء والمواقف والأعمال الإبداعية، سواء بدعوى الردع العام أو الخاص، والحد من متابعتهم بمقتضيات القانون الجنائي في القضايا المرتبطة بالإبداع والتعبير الفني، خاصة أن الفنانين عموما وفناني الراب خصوصا أكثر عرضة لتأويل أعمالهم خارج سياقها الفني والإبداعي

- The immediate release of rapper and filmmaker El Mahdi Lyoubi, known professionally as Mehdi Black Wind, or, at the very least, his provisional release pending the conclusion of all judicial proceedings.
- An end to the prosecution of rappers in particular, and artists more broadly, because of their opinions, public positions, and artistic work. We call for full respect for freedom of artistic creation and expression, recognition of rap as a legitimate artistic form, and protection of artists' rights, as guaranteed by the Moroccan Constitution, national legislation, and Morocco's international commitments to freedom of expression and cultural rights.
- The swift adoption of a legal framework that protects artists, prevents the use of custodial sentences for opinions, political positions, and creative works, and limits the application of criminal law in cases related to artistic creation and expression. Artists, particularly rappers, are too often exposed to interpretations of their work that disregard its artistic and creative context.
