Freedom for Rached Ghannouchi and all political prisoners in Tunisia

In the evening of April 17, 2023, on the night of the 27th of Ramadan, which is of particular symbolic significance for Muslims, large numbers of security forces in civilian clothes surrounded the house of Mr. Rached Ghannouchi, the former Speaker of Parliament and leader of the Ennahdha Party, before raiding the house, conducting an extensive search of rooms, and confiscating personal documents, including Mr. Ghannouchi’s personal diaries and electronics. They, then, led him to an unknown location. Two days after his arbitrary arrest and in the absence of his lawyers, an imprisonment order was issued against Mr. Ghannouchi by Office no. 33 of the Tunis Court of First Instance, on charges of conspiracy against state security and seeking to change the nature of the state, which can carry the death sentence, in violation of the most basic principles of fair trial and due process. This investigation was based on a statement made by Mr. Ghannouchi at an event organized the National Salvation Front at its headquarters the night before. Mr. Ghannouchi's words were deliberately distorted and taken out of context to justify his arbitrary arrest.

In light of this, we, the undersigned, intellectuals, academics, parliamentarians and public figures, and supporters of freedom, express the following:

First: we condemn the arbitrary arrest of Mr. Rached Ghannouchi, a renowned thinker widely considered as the founding father of democratic Islam. He played a key role in his country’s democratic transition and has as a result been subject to a virulent demonisation campaign.

Second: We call for the unconditional release of Mr. Ghannouchi and all political detainees. We urge the Tunisian authorities to respect their international commitments and all the international human rights treaties they themselves have ratified.

Third: We call on the Tunisian authorities to put an end to this dangerous policy of dismantling political institutions and destroying the nascent democratic system in a country that is regarded as a successful and inspiring model in the struggling Arab Spring countries.

الحرية لراشد الغنوشي و جميع المعتقلين السياسيين في تونس

مساء يوم 17 أبريل 2023، ليلة السابع والعشرين من رمضان التي يجلها المسلمون، حاصرت أعداد غفيرة من القوات الأمنية بلباس مدني منزل السيد راشد الغنوشي، رئيس مجلس النواب الأسبق المنتخب وزعيم حزب النهضة، قبل أن تداهم البيت، وتجري تفتيشاً شاملاً للغرف، وتصادر الوثائق الشخصية، بما فيها مذكرات الأستاذ راشد الشخصية، ناهيك عن الأجهزة الإلكترونية، ثم اقتادته إلى مكان مجهول.

بعد مضي يومين على هذا الاعتقال التعسفي وفي تغييب تام لمحاميه،
أصدر قاضي التحقيق بطاقة إيداع بالسجن بحق الأستاذ راشد بتهمة "التآمر على أمن الدولة والاعتداء المقصود منه تبديل هيئة الدولة"، وهي تهم خطيرة تصل عقوبتها إلى الإعدام، في خرق فاضح لأبسط مبادئ المحاكمة العادلة.

تجدر الإشارة الى أنَ هذا التحقيق فُتح بناءً على ما صرح به الأستاذ راشد في اجتماع عقدته جبهة الخلاص الوطني المعارضة بمقرها خلال سهرة رمضانية، حُرّف ما ورد فيه واجتزئ بعضه ليتخذ ذريعة للاعتقال التعسفي.

على ضوء ما ذكر، نحن الموقعون أدناه، مفكرون وأكاديميون وبرلمانيون وشخصيات عامة داعمة للحرية نعبر عما يلي:

أولا: إدانتنا للاعتقال التعسفي للأستاذ راشد الغنوشي، المفكر المعروف الذي يعدّ الأب المؤسس للإسلام الديمقراطي. وقد لعب الغنوشي دوراً محورياً في التحول الديمقراطي ببلاده، ما جعله عرضة لحملة شيطنة شعواء من معسكر الاستبداد العربي.

ثانيا: دعوتنا لإطلاق سراح الأستاذ راشد، وكل المعتقلين السياسيين، فوراً ودون قيد أو شرط. كما نحثَ السلطات التونسية على احترام التزاماتها الدولية والمعاهدات الدولية لحقوق الانسان التي صادقت عليها.

ثالثا: ندعو السلطات التونسية أن تنتهي عن هذه السياسية الرعناء الرامية لتفكيك المؤسسات السياسية وتدمير النظام الديمقراطي الناشئ، الذي عدّ نموذجا ناجحاً وملهماً لشعوب المنطقة، قبل انزلاقه في متاهات الانقلاب والتسلط والمحاكمات السياسية الجائرة.

DİLEKÇE: Rached Gannouchi ve Tunustaki tüm siyasi mahkumlar için özgürlük

17 Nisan 2023 akşamı, Müslümanlar için özel bir sembolik öneme sahip olan Ramazan'ın 27'nci gecesinde, sivil giyimli çok sayıda güvenlik gücü, eski Parlamento Başkanı Rached Ghannouchi'nin evini kuşattı. Nahdha Partisi liderinin, evine baskın yapıldı, odaları kapsamlı bir şekilde arandı ve Bay Ghannouchi'nin kişisel günlükleri ve elektronik eşyaları da dahil olmak üzere tüm kişisel belgelerine el koyuldu Daha sonra Ghannouchi bilinmeyen bir yere götürüldü.

Keyfi olarak tutuklanmasına iki gün sonra ve avukatlarının yokluğunda Bay Ghannouchi'ye Tunus Adliye Mahkemesinin 30.maddesine göre devlet güvenliğine karşı komplo kurma, adil yargılanma ve yargı sürecinin en temel ilkelerini ihlalinde ölüm cezası verebilen devletin yapısını değiştirmeye çalışma iddiasıyla hapis cezası verildi.

Bu soruşturma, Ulusal Selamet Cephesi'nin bir gece önce karargahında düzenlediği bir etkinlikte Bay Ghannouchi tarafından yapılan bir açıklamaya dayanıyordu. Bay Ghannouchi'nin sözleri kasıtlı olarak çarpıtıldı ve keyfi olarak tutuklanmasını haklı çıkarmak için bağlamından koparıldı.

Bunun ışığında, aşağıda imzası bulunan bizler, aydınlar, akademisyenler, milletvekilleri ve kamuya mal olmuş kişiler ve özgürlük savunucuları olarak şunları ifade ediyoruz:

İlk olarak: yaygın olarak demokratik İslam'ın kurucu babası olarak kabul edilen ünlü bir düşünür olan Bay Rached Ghannouchi'nin keyfi olarak tutuklanmasını kınıyoruz. Ülkesinin demokratik geçiş sürecinde kilit bir rol oynadı ve sonuç olarak şiddetli bir şeytanlaştırma kampanyasına maruz kaldı.

İkincisi: Bay Ghannouchi'nin ve tüm siyasi tutukluların koşulsuz olarak serbest bırakılması için çağrıda bulunuyoruz. Tunus makamlarını uluslararası taahhütlerine ve onayladıkları tüm uluslararası insan hakları anlaşmalarına saygı duymaya çağırıyoruz.

Üçüncüsü: Tunuslu yetkilileri, mücadele eden Arap Baharı ülkelerinde başarılı ve ilham verici bir model olarak görülen bir ülkede siyasi kurumları tasfiye etmeye ve yeni oluşan demokratik sistemi yok etmeye yönelik bu tehlikeli politikaya son vermeye çağırıyoruz.


PÉTITION : Liberté pour Ghannouchi et les autres prisonniers politiques

Dans la soirée du 17 avril 2023, la nuit du 27e Ramadan, qui revêt une importance symbolique particulière pour les musulmans, un grand nombre de membres des forces de sécurité en civil ont encerclé la maison de M. Rached Ghannouchi, président du Parlement démocratiquement élu en 2019 et chef du parti Ennahdha, avant de procéder à une perquisition dans sa maison, de procéder à une fouille approfondie de chaque pièce et de confisquer des documents personnels, y compris les journaux intimes et les appareils électroniques de M. Ghannouchi. Ils l'ont ensuite conduit dans un lieu inconnu.

Deux jours après son arrestation arbitraire et en l'absence de ses avocats, un mandat d’arrêt a été émis à son encontre, pour « conspiration contre la sécurité de l'État et tentative de changement de la nature de l'État », des accusations passibles de la peine de mort, en complète violation des principes les plus élémentaires d'un procès équitable et du respect des procédures légales.

Cette enquête était basée sur une déclaration faite par M. Ghannouchi lors d'un événement organisé par le Front de Salut National à son siège la veille. Les propos de M. Ghannouchi ont été délibérément déformés et sortis de leur contexte pour justifier son arrestation arbitraire.

A la lumière de ce qui précède, nous, soussignés, intellectuels, universitaires, parlementaires et personnalités publiques, défenseurs de la liberté, exprimons ce qui suit :

Tout d'abord: nous condamnons l'arrestation arbitraire de M. Rached Ghannouchi, un penseur de renom largement considéré comme le père fondateur de l'islam démocratique. Il a joué un rôle clé dans la transition démocratique de son pays et a, de ce fait, fait l'objet d'une virulente campagne de diabolisation.

Deuxièmement: Nous demandons la libération immédiate et inconditionnelle de M. Ghannouchi et de tous les détenus politiques. Nous exhortons les autorités tunisiennes à respecter leurs engagements internationaux et tous les traités internationaux relatifs aux droits de l'homme, qu'elles ont elles-mêmes ratifié.

Troisièmement: Nous appelons les autorités tunisiennes à mettre fin à cette politique dangereuse de démantèlement des institutions politiques et de destruction du système démocratique naissant, dans un pays qui avait été considéré comme un modèle politique réussi et inspirant dans la région.
