الطالب الجامعي عاصم عمر حسن يواجه إجراءات إحتجاز تعسفي وتعذيب وحكم بالإعــدام بالسـودان
يتعرض الطالب عاصم عمر حسن 24 سنة، الطالب بجامعة الخرطوم وعضو مؤتمر الطلاب المستقلين (تنظيم سياسي طلابي) إلى إجراءات إحتجاز تعسفي منذ 2 مايو 2016 بواسطة جهاز الأمن والمخابرات الوطني السوداني والشرطة السودانية وتم حرمانه من حقوقه الدستورية والقانونية أثناء القبض عليه أمام بوابة جامعة الخرطوم وفي مراحل التحري والإحالة مما يجعل حياته في خطر ماثل، وبعد مضي 6 أيام من أعتقاله قامت السلطات السودانية بقيد بلاغ جنائي ضده تحت المادة (130) من القانون الجنائي السوداني لسنة 1991 (القتل العمد) ومنعت السلطات السودانية المحامين المكلفين بالدفاع عنه مقابلته أو معرفة أسباب القبض عليه، ولم تسمح السلطات السودانية بالاتصال بأسرته أو محاميه ويعتقد أن الطالب عاصم عمر محتجزاً لدى شرطة القسم الشمالي وسط العاصمة السودانية الخرطوم ولكن لا يعرف مكان أحتجازه على وجه التحديد، وتعرض عاصم عمر لعدة أعتقالات في السابق نسبة لنشاطه السلمي وسط الطلاب، حيث حكم عليه بالجلد في يوليو/2015 كعقوبة جسدية لمشاركته في مخاطبة سلمية أقامها حزب المؤتمر السوداني (حزب سياسي مسجل طبقاً للقانون) في سوق صابرين بأمدرمان العاصمة التاريخية لجمهورية السودان وهنالك بواعث قلق على حياة الطالب عاصم عمر حيث درجت السلطات السودانية على ممارسة تعذيب ممنهج ضد المعتقلين والمحتجزين لدى الأجهزة الأمنية والشرطية وحبسهم في أماكن مجهولة ونائية وغير معروفة ، كما أن هنالك بواعث قلق أخرى على السلامة الجسدية والنفسية لعدد من الطلاب والطالبات الذين تم إعتقالهم يوم الخميس 5/مايو/2016 بعد مداهمة السلطات السودانية لمكتب المحاميان نبيل أديب ومنال خوجلي (ناشطين في مجال حقوق الأنسان) بالخرطوم حيث كان الطلاب ينشدون المساعدة القانونية وهم :- 1- وفاق محمد القرشي الطيب - جامعة الخرطوم -كلية الآداب المستوى الثالث – مفصولة نهائياً 2- محمد محجوب محمد عتيبة – جامعة الخرطوم – كلية القانون المستوى الرابع – مفصول نهائياً 3- مدثر تيسير مدثر سليمان – جامعة الخرطوم – كلية العلوم المستوى الخامس (كيمياء) – موقوف عن الدراسة لعامين 4- حسين يحي حران برنو – جامعة الخرطوم – كلية العلوم المستوى الرابع (فيزياء) – موقوف عن الدراسة لعامين 5- مي عادل إبراهيم محمد - جامعة الخرطوم – كلية الهندسة المستوى الرابع (كهرباء) - موقوفة عن الدراسة لعامين 6- بدرالدين صلاح محمد – جامعة الخرطوم – كلية الإقتصاد – المستوى الأول - موقوف عن الدراسة لعامين 7- عبدالباقي حسين آدم – جامعة الخرطوم – كلية القانون – المستوى الرابع - موقوف عن الدراسة لعامين وقامت أجهزة النظام الأمنية بملاحقة بقية الطلاب المفصولين والموقوفين عن الدراسة لعامين من غير الحاضرين للإجتماع فأعتقلت لاحقاً كل من: 1- محمد عمر حامد - جامعة الخرطوم – كلية الهندسة المستوى الخامس (ميكانيكا) – مفصول نهائياً 2- نفيسة محمد حسين – جامعة الخرطوم – كلية القانون – المستوى الثاني – مفصولة نهائياً 3- فتحي محمد عبده – جامعة الخرطوم – كلية الإقتصاد – المستوى االرابع - موقوف عن الدراسة لعامين 4- موفق محمد إبراهيم - جامعة الخرطوم – كلية الهندسة المستوى الرابع ويدعو القطاع القانوني لحزب المؤتمر السوداني بالتضامن مع هيئة الدفاع عن الطلاب السلطات السودانية إلى إطلاق سراح الطالب عاصم عمر دون شرط مسبق أو توجيه الإتهام له بناءاً على إجراءات سليمة من القانون وإحالته للقاضي الطبيعي دون تأخير وضمان سلامة الطالب النفسيـــــــــــــــة والعقلية والجسدية وحمايته من كافة أشكال التعذيب والمعاملة القاسية ، المهينة واللاانسانية ، ومراعاة وثيقة حقوق الأنسان المنصوص عليها في الدستور الأنتقالي لعام 2005 ، واتباع كافة الضمانات المتعلقة بالإعتقال والتحري والأحالة بما فيها ضمانات المحاكمة العادلة أثناء القبض والتحري وعند الإحالة والمحاكمة والموافقة دون شرط مسبق على السماح لمحامي الطالب عاصم عمر بمقابلته على إنفراد ودون رقابة لصيقة وعلى مرأى وليس مسمع من السلطات الأمنية . السماح للطالب عاصم عمر بالأتصال والتواصل مع العالم الخارجي بما في ذلك أسرته . السماح للطالب عاصم عمر بالأتصال بطبيب خاص أن طلب ذلك . كما يناشد القطاع القانوني لحزب المؤتمر السوداني بالتضامن مع هيئة الدفاع عن الطلاب كافة منظمات حقوق الأنسان الوطنية والإقليمية والدولية والمدافعين عن حقوق الأنسان إلى المطالبة بإطلاق سراح جميع الطلاب المعتقلين وعودتهم إلى مقاعد الدراسة الجامعية ، كما يدعو إلى الضغط على السلطات السودانية من أجل ضمان سلامتهم النفسية والجسدية وحمايتهم من التعرض للتعذيب وكافة صنوف المعاملة غير الكريمة . خلفيـــــــــــــــة : عقب تصريحات لمسئولين سودانين في نهاية ابريل/2016 ببيع مباني جامعة الخرطوم العريقة التي تأسست في العام 1902 والتي تعد واحدة من المباني الأثرية بجمهورية السودان إنخرط طلاب جامعة الخرطوم في مظاهرات سلمية منددة بالقرار ومطالبة بإلغائه ، فتصدت لهم السلطات السودانية وأستعملت القوة المفرطة والرصاص الحي والمطاطي مما أدى لمقتل الطالب محمد الصادق 20 سنة كلية الاداب جامعة أم درمان الأهلية في 27/أبريل/2016 وإصابات العشرات من الطلاب بجروح وأصابات مختلفــــــــــة . وقامت السلطات السودانية بإعتقال العشرات من طلاب جامعة الخرطوم وجامعات أخرى شاركو في عمليات الإحتجاج حيث تعرض الكثير منهم لعمليات تعذيب ممنهج ، كما مارست السلطات السودانية ضغوطاً على إدارة جامعة الخرطوم تم بموجبها فصل عدد (11) طالب وطالبة فصلاً نهائياً وتجميد الدراسة لآخرين . وفي تطور جديد قامت السلطات السودانية بالأمس بالإعلان عن توجيه تهمة القتل العمد للطالب عاصم عمر ، فيما يبدو أنه إشارة رد على تصريحات الأجهزة الأمنية السودانية أن أحد منسوبيها مات مقتولاً أثناء المظاهرات المذكورة .

University student Asim Omar Hassan faces arbitrary arrest proceedings, torture, and death sentence in Sudan Asim Omar Hassan, a 20/21 year old student at the Faculty of Administrative Sciences, University of Khartoum, and member of Conference of Independent Students CIS (a student political organization) is facing arbitrary arrest measures by the National Intelligence and Security Services (NISS) since May 2nd 2016. The Sudanese police forces denied Asim his legal and constitutional rights during the stages of his arrest from the university campus, subsequent remand and investigation, which places his life in immediate danger. Six days following his arrest, the Sudanese authorities have pressed criminal charges against Asim under article 130 (intentional murder) of the Sudanese Criminal Law of 1991. The Sudanese authorities have prevented attorney designated for Asim’s defense from meeting him in order to investigate his arrest. Asim was denied contact with his family or legal representatives. It is believed that Asim is held at Northern police department in central Khartoum, however there is no knowledge of his specific whereabouts. Asim has faced multiple arrests on the basis of his peaceful activity amidst students. He was sentenced to flogging as a corporal punishment for his participation in a peaceful public address held by the Sudanese Congress Party in Sabreen market at the historical Sudanese capital of Omdurman. There are motives which cause concern for the life of Asim Omar, as the Sudanese authorities are accustomed to performing acts of systematized torture towards those held in detention and arrest, in addition to locking them in cells in unknown, and remote locations. There are also concerns for the physical and psychological states of a number of students, who were detained on May 5th2016, following the Sudanese authorities’ raid of the offices of lawyers and human rights defenders Nabeel Adeeb and Manal Khogali, in Khartoum, during the students’ appeal for legal support. The students are: 1) Wifag Gorashi Al Zain Abdalaziz, University of Khartoum, 4th year, Faculty of Economics- Suspended permanently 2) Mohamed Mahjoub Mohamed Otaiba, University of Khartoum, 4th year, Faculty of Law- Suspended permanently 3) Mudathir Tayseer Mudathir Suleiman, University of Khartoum, 5th year, Faculty of Sciences (Chemistry)- Suspended for 2 years 4) Hussein Yahya Harran Barnu, University of Khartoum, 4th year, Faculty of Sciences (Physics)- Suspended for 2 years 5) Mai Adil Ibraheem Mohamed, University of Khartoum, 4th year Faculty of Engineering (Electrical Engineering)- Suspended for 2 years 6) Badr Al-Deen Salah Mohamed, University of Khartoum, 1st year Faculty of Economics- Suspended for 2 years 7) Abdulbagi Hussein Adam, University of Khartoum, 4th year, Faculty of Law- Suspended for 2 years The NISS pursued students who were suspended from the university, subsequently detaining those who were not present at Addeeb and Khogali’s office. These students are: 1) Mohamed Omar Hamid, University of Khartoum, 5th year, Faculty of Engineering (Mechanical Engineering)- Suspended permanently 2) Nafisa Mohamed Hussein, University of Khartoum, 2nd year, Faculty of Law-Suspended permanently 3) Fathi Mohamed Abud, University of Khartoum, 4th year, Faculty of Economics-Suspended for two years 4) Mowafag Mohamed Ibraheem, University of Khartoum, 4th year, Faculty of Engineering. The legal sector of the Sudanese Congress Party calls for: · Release of Asim Omar without a condition precedent, or arraign him on the basis of sound procedures, and transfer his case to a competent judge without delay · Guarantee the physical, mental, and psychological safety of Asim, and his protection from all forms of cruel and ill treatment, and degrading, inhuman torture · Respect of, and compliance with the human rights bill set forth in the interim constitution of 2005, and abide by all procedures for a fair due process during arrest, detention, remand and trial · Agree without a condition precedent to allow designated legal representatives to meet Asim in privacy, without any interfering surveillance from authorities · Allow Asim contact with the outside world, including his family · Allow Asim to seek medical care from a private physician, upon his request The Legal sector of the Sudanese Congress party, in solidarity with the Commission for Student Defense, calls upon all national, regional and international human rights organizations, and human rights defenders, to demand release of all students and their rightful return to their universities. The legal sector calls for pressuring the Sudanese authorities to ensure the physical and psychological well-being of the detainees, and their protection from torture and all forms of inhumane and ill treatments. Background Following announcements made by Sudanese officials to sell-off the highly venerated University of Khartoum, which was founded in 1902, the students of the University of Khartoum took part in peaceful demonstrations condemning the sell-off decision and demanded its revocation. Sudanese authorities confronted the peaceful demonstration with the use of excessive force by using live ammunition and rubber bullets, which led to the killing of 20 year old Omdurman Al-Ahlia University’s Faculty of Arts student Mohamed Al Sadiq, on April 27th 2016, and injury to tens of others. Sudanese authorities arrested tens of students from the University of Khartoum, as well as from other universities taking part in demonstrations. The arrested students faced acts of systematized torture. Pressures placed by authorities on the University of Khartoum administration led to the definitive suspension of 11 students, and freezing the attendance of others. In drastic developments, authorities pressed murder charges on Asim Omar, which appears to have been in response to allegations made by security services that a member was killed during the above mentioned demonstrations.

Sudanese authorities confronted the peaceful demonstration with the use of excessive force by using live ammunition and rubber bullets, which led to the killing of 20 year old Omdurman Al-Ahlia University’s Faculty of Arts student Mohamed Al Sadiq, on April 27th 2016, and injury to tens of others. Sudanese authorities arrested tens of students from the University of Khartoum, as well as from other universities taking part in demonstrations. The arrested students faced acts of systematized torture. Pressures placed by authorities on the University of Khartoum administration led to the definitive suspension of 11 students, and freezing the attendance of others. In drastic developments, authorities pressed murder charges on Asim Omar, which appears to have been in response to allegations made by security services that a member was killed during the above mentioned demonstrations.
