Hamilton Municipal Court Judge Daniel Gattermeyer needs to be relieved of his duties.

Elizabeth Lewis an older teen first appeared in his courtroom after her dog Bruiser was taken into custody. Bruiser was gaunt. At 4 months, he weighed only 17 lbs. and was taken in by an animal rescue agency. The rescue fed him and brought him back to a healthy 38 lbs. Lewis claimed he had an illness that made him lose weight. During a bench trial Lewis was found not guilty by Judge Gattermeyer and Bruiser was returned to Lewis' home.

In February of 2013, Bruiser, now 10 months old, again was removed from Lewis' home. He was so emaciated he fell down the stairs to Lewis' apartment and there was no tissue around his bones. This time he had to be humanely euthanized. The same Judge presided over the second case. This time Lewis pleaded no contest and was sentenced to 180 days of jail time; however Gattermeyer suspended half her sentence. Oddly enough, the Judge also ordered her to get her GED and essentially scolded her like a child.

Lewis claimed both times that the dog had an illness, mange, that caused him to lose and gain weight. She simply could not afford a vet. One does not simply decide to not treat an animal IF they are sick in the first place, and it's not just some negligence on the owner's part. You get your animals medical care the same way you would a child. Just because they can suffer in silence does not make this horrid form of neglect okay by any means. In addition, she had the option the first time around of giving the animal up. If she was so concerned she could not afford care, she should have allowed the rescue to keep him. Mange is caused when the immune system is no longer able to keep the mite population under control on a dog's body. This lowered immunity can be caused by severe mental or physical stress or a severe illness. When presented with the facts of the case, it is clear that Bruiser either had a third, unnamed illness or succumbed to profound physical and/or mental distress.

Furthermore, it should be noted the FBI has found young animal abusers are likely to move on to human targets (see article link below). The fact remains that Lewis was only 19 when she went to court the SECOND time. In addition, she was several months pregnant. Did anyone consider the safety of the child much less another animal in Lewis's care? Apparently not. All of this occurred despite the protests in support of justice for Bruiser that were going on outside of Gattermeyer's courtroom. This judge was negligent and failed to do his job by his own choice, and thus has failed the public. Twice.

We the undersigned respectfully request that Judge Gattermeyer be relieved of his duties. He has violated Canon 2 of the Ohio Code of Judicial Conduct and Canon 3 of the Code of Conduct for United States Judges.

1. We believe he is not competent because even a writer and someone with a psychology and business degree are able to more clearly see the facts of this case and the potential outcome for the public.

2. We believe Judge Gattermeyer lacks impartiality because he appears to feel sorry for the young felon, ordering her to get her GED and softening her sentence.

3. Part of Canon 2 of the Ohio Code of Judicial Conduct is "ensuring the right to be heard". The only victim in this story was presented as a mangy dog. Where was Judge Gattermeyer's reprieve for Bruiser?

4. Animal abuse is considered a Class A tier crime by the FBI. Judge Gattermeyer dispensed with the responsibility of Americans' trust to carry out the public's wishes and apply a reasonable sentence, or treat with any seriousness animal abuse/neglect cases.

5. Finally, Judge Gattermeyer is apathetic to the rights and safety of animals, and in the long run, the safety of children and society. We will see Elizabeth Lewis in court again, next time for child abuse or neglect. None of this should've ever happened.
