بدأ انزلاق مسار التنازل عن مطالب الشعب السوري منذ القبول بمناقشة السلال الأربعة التي طرحها دي مستورا بطلب روسي في جنيف 4 وهي الحكم والانتقال السياسي، الدستور الجديد، الانتخابات، ومحاربة الإرهاب، واستمر الانزلاق المدروس بالقبول بمناقشة بند واحد وهو المسار الدستوري وتجاهل تام لقضية إطلاق سراح المعتقلين ووقف إطلاق النار والحكم والانتقال السياسي، واكتملت فصول الهزيمة باعتبار انشاء لجنة دستورية هو ملخص لكل مطالب الشعب السوري،
نص بيان جنيف 1 على الحد الأدنى لمطالب الشعب السوري وكان يشكل نقطة بداية وعبور حقيقية لتحقيق مطالب السوريين بدولة تحترم كرامتهم وحريتهم ومما جاء فيه وبالترتيب:
1- بناء الثقة عبر وقف إطلاق النار وإطلاق سراح المعتقلين ورفع الحصار وحرية التنقل والتظاهر السلمي والسماح للمنظمات الدولية بالوصول لكل المناطق
2- أي تسوية سياسية يجب أن تقدِّم لشعب الجمهورية العربية السورية عملية انتقاليًة
3- إقامة هيئة حكم انتقالية باستطاعتها أن تُهيّئ بيئة محايدة تتحرك في ظلها العملية الانتقالية. وأن تمارس هيئة الحكم الانتقالية كامل السلطات التنفيذية
4- على هذا الأساس، يمكن أن يعاد النظر في النظام الدستوري والمنظومة القانونية. وأن تُعرض نتائج الصياغة الدستورية على الاستفتاء العام.
وجاء القرار الأممي الصادر عن مجلس الأمن برقم 2254 ليتبنى بيان جنيف كمرجعية للحل في سوريا ويؤكد على عملية انتقال سياسي:
1- يؤكد من جديد تأييده لبيان جنيف المؤرخ 30 حزيران/يونيه 2012في إطار السعي إلى كفالة التنفيذ الكامل كأساس لانتقال سياسي
2- يسلّم بالصلة الوثيقة بين وقف إطلاق النار وانطلاق عملية سياسية موازية، عملا ببيان جنيف لعام 2012،
3- يدعو الأطراف إلى أن تتيح فورا للوكالات الإنسانية إمكانية الوصول السريع والمأمون وغير المعرقل إلى جميع أنحاء سورية ومن خلال أقصر الطرق، وأن تسمح فورا بوصول المساعدات الإنسانية إلى جميع من هم في حاجة إليها، لا سيما في جميع المناطق المحاصرة والتي يصعب الوصول إليها، والإفراج عن أي محتجزين بشكل تعسفي،
ماذا حققت اللجنة الدستورية من هذه المطالب؟
حقيقة الأمر أن اختراع مسألة اللجنة الدستورية جاء لتجاوز كل هذه المطالب , فقد قفز أولا فوق موضوع وقف إطلاق النار وكان من يدّعون تمثيلهم لمطالب الشعب السوري يدخلون بمتاهات النقاش والبراميل المتفجرة والأسلحة الكيماوية وقصف الطيران يحصد أرواح المدنيين السوريين ويفتك بهم ويدمر مشافيهم وأفرانهم ومدارسهم وبيوتهم, وكان وما زال عشرات آلاف المعتقلين مغيبين قسريا لسنوات طويلة ويموتون يوميا بسبب التعذيب وشروط الاعتقال غير الإنسانية , وآلاف المدنيين ماتوا من الحصار , إلى مالا يحصى من الجرائم ضد الإنسانية وجرائم الحرب ترتكب يوميا بحق السوريين , ومع ذلك لم يهتز جفن لمن ادعى تمثيله لمطالب الشعب السوري واستمر بالانزلاق في مجرى صنعته روسيا المجرمة بحق الشعب السوري,
والأهم ذلك كله هو إلغاء كامل للمطلب الأول وهو العملية الانتقالية وإقامة هيئة حكم انتقالية ذات صلاحيات تنفيذية كاملة هي وحدها صاحبة الحق بإعادة النظر بالنظام الدستوري والمنظومة القانونية، بما معناه الحرفي التنازل التام عن مطلب الانتقال لدولة ديمقراطية،
وهذا يؤدي بناء للمسألة الأخطر بموضوع اللجنة الدستورية وهو إعادة الشرعية لنظام القتل أن يقود كل العملية السياسية وبشروطه وحده، ومنحه كل الحق أن يحدد مسار وحدود ما يجري, وتقديم العذر والمبرر للمجتمع الدولي ليترك الشعب السوري لمصيره الأسود دون تدخل باعتبار أن " ممثلي الشعب " قد قبلوا بهذا المسار للوصول لطلباتهم ولا داعي لمسارات مختلفة،
وأن " ممثلي الشعب المعارض " قبلوا بالسير بهذا المسار رغم عدم وقف القتل بكل أشكاله ورغم عدم إطلاق سراح المعتقلين ورغم عدم محاسبة المجرمين ورغم عدم السماح للأمم المتحدة والمنظمات الدولية بالوصول لكل السوريين المحتاجين، لذلك لا يمكن لوم المجتمع الدولي فلن يكون ملكيا أكثر من الملك،
إننا إذ نؤكد الرفض التام للجنة الدستورية باعتبار القبول والسير فيها سيكون أكبر انتكاسة لمطالب الشعب السوري لأنها تعطي المبرر من قبل من يعتبر " ممثل لمطالب الشعب السوري المعارض" للمجتمع الدولي أن يستمر بتجاهله لمعاناة هذا الشعب ويعيد الشرعية لنظام مجرم قاتل أقر كل العالم بجرائمه وبدأت جهات قضائية بإصدار مذكرات توقيف دولية بحق رموزه،
ويتنازل بكل وقاحة عن أهم مكسبين للشعب السوري وهما بيان جنيف 1 وقرار مجلس الأمن 2254 ,
والأهم أنه يتجاهل معاناة أكثر من مائة وخمسين ألف معتقل مازالوا مغيبين قسرا ومجهولي المصير ومعاناة عوائلهم، ويتجاهل أكثر من خمسين ألف ضحية قتلوا تحت التعذيب وأخفيت جثثهم، ويتجاهل استمرار القتل والتدمير بكل أنواع الأسلحة للشعب والمدن السورية.
كان من المفروض أن يكون عمل هذه اللجنة موجها للعمل على هيئة الحكم الانتقالي وكنا سنقبل أي اختيارات لهذه الهيئة لأنها تعبر عن بداية الحل وليس إغلاق مساراته كما قامت به اللجنة الدستورية،
إن اللجنة الدستورية لم ولن تكون خطوة على طريق تحقيق مطالب الشعب السوري لدولة الكرامة والحرية بل يغلق الطريق إليها نهائيا وكأن كل تضحيات الشعب السوري ذهبت هدرا ويفتح طريقا أسودا لسوريا يجب أن نرفض السير به
لذلك نطالب الجميع وكل من يهمه مستقبل سوريا أن يعلن رفضه للجنة الدستورية كمسار وخطوة مطلوبة الآن، وأن يتم إنشاء تحالف القوى السورية المؤمنة بسوريا ديمقراطية مدنية خالية من الاستبداد بكل أشكاله لوأد مسار اللجنة الدستورية
وإننا ندعو من ظن أنه يقدم شيئا إيجابيا للشعب السوري بدخوله هذا المستنقع أن يعلن انسحابه ومقاطعته لهذه اللجنة ربما هذا لن يعيد الثقة به ولكن على الأقل للحفاظ على ماء وجهه،
ونطالب المجتمع الدولي بالالتزام بقراراته والتزاماته والعمل على إنشاء هيئة حكم انتقالي خلال مدة ستة أشهر كما نص عبه بيان جنيف 1 تكون لها كامل الصلاحية التنفيذية ويتم الاعتراف بها دوليا لتقوم بالمهام المنوطة بها بموجب القرارات الدولية لوضع سوريا على سكة الحل المؤدي لسلامة سوريا وطنا وشعبا وليس على سكة الدمار والتدمير
كما نطالب المجتمع الدولي أن يمتنع عن إجراء أي مفاوضات أو محادثات مع مجرمي الحرب والمجرمين ضد الإنسانية من كل الأطراف والذين أصبحوا موضع اتهام أمام الجهات القضائية وصدرت مذكرات توقيف بحق عدد منهم واعتبار هؤلاء خارج أي حل سياسي أو ان يكونوا جزء من مستقبل سوريا،
بهذا فقط يمكن أن نصدق أن قيم حقوق الإنسان وقيم الكرامة والحرية والعدالة ما زالت موجودة ويؤمن ويعمل لها أحد ما بهذا العالم وأن الدول تحترم التزاماتها وقرارتها وإلا فلا معنى لأي قانون ولا لأي ضابط ولا يمكن لوم أي خارج عن القانون من قبل من لا يلتزم به.

What has the Constitutional Commission achieved from these demands?

The representatives of the opposition people have agreed to follow this path despite the fact that all forms of murder are not stopped, the detainees are not released, the criminals are not held accountable, and the UN and international organizations are not allowed access to all Syrians in need. Therefore, the international community cannot be blamed.
We reaffirm the complete rejection of the Constitutional Committee, considering that acceptance and conduct will be the biggest setback for the demands of the Syrian people because they give the justification by those who are considered "representative of the demands of the Syrian people opposed" to the international community to continue to ignore the suffering of this people and restore legitimacy to a murderous criminal regime that has acknowledged all its crimes. The Constitutional Committee has not and will not be a step towards the fulfillment of the Syrian people's demands for a state of dignity and freedom, but closes the road to it once and for all as the sacrifices of the Syrian people have gone to waste and open a black road to Syria must refuse to walk

نص بيان جنيف 1 على الحد الأدنى لمطالب الشعب السوري وكان يشكل نقطة بداية وعبور حقيقية لتحقيق مطالب السوريين بدولة تحترم كرامتهم وحريتهم ومما جاء فيه وبالترتيب:
1- بناء الثقة عبر وقف إطلاق النار وإطلاق سراح المعتقلين ورفع الحصار وحرية التنقل والتظاهر السلمي والسماح للمنظمات الدولية بالوصول لكل المناطق
2- أي تسوية سياسية يجب أن تقدِّم لشعب الجمهورية العربية السورية عملية انتقاليًة
3- إقامة هيئة حكم انتقالية باستطاعتها أن تُهيّئ بيئة محايدة تتحرك في ظلها العملية الانتقالية. وأن تمارس هيئة الحكم الانتقالية كامل السلطات التنفيذية
4- على هذا الأساس، يمكن أن يعاد النظر في النظام الدستوري والمنظومة القانونية. وأن تُعرض نتائج الصياغة الدستورية على الاستفتاء العام.
وجاء القرار الأممي الصادر عن مجلس الأمن برقم 2254 ليتبنى بيان جنيف كمرجعية للحل في سوريا ويؤكد على عملية انتقال سياسي:
1- يؤكد من جديد تأييده لبيان جنيف المؤرخ 30 حزيران/يونيه 2012في إطار السعي إلى كفالة التنفيذ الكامل كأساس لانتقال سياسي
2- يسلّم بالصلة الوثيقة بين وقف إطلاق النار وانطلاق عملية سياسية موازية، عملا ببيان جنيف لعام 2012،
3- يدعو الأطراف إلى أن تتيح فورا للوكالات الإنسانية إمكانية الوصول السريع والمأمون وغير المعرقل إلى جميع أنحاء سورية ومن خلال أقصر الطرق، وأن تسمح فورا بوصول المساعدات الإنسانية إلى جميع من هم في حاجة إليها، لا سيما في جميع المناطق المحاصرة والتي يصعب الوصول إليها، والإفراج عن أي محتجزين بشكل تعسفي،
ماذا حققت اللجنة الدستورية من هذه المطالب؟
حقيقة الأمر أن اختراع مسألة اللجنة الدستورية جاء لتجاوز كل هذه المطالب , فقد قفز أولا فوق موضوع وقف إطلاق النار وكان من يدّعون تمثيلهم لمطالب الشعب السوري يدخلون بمتاهات النقاش والبراميل المتفجرة والأسلحة الكيماوية وقصف الطيران يحصد أرواح المدنيين السوريين ويفتك بهم ويدمر مشافيهم وأفرانهم ومدارسهم وبيوتهم, وكان وما زال عشرات آلاف المعتقلين مغيبين قسريا لسنوات طويلة ويموتون يوميا بسبب التعذيب وشروط الاعتقال غير الإنسانية , وآلاف المدنيين ماتوا من الحصار , إلى مالا يحصى من الجرائم ضد الإنسانية وجرائم الحرب ترتكب يوميا بحق السوريين , ومع ذلك لم يهتز جفن لمن ادعى تمثيله لمطالب الشعب السوري واستمر بالانزلاق في مجرى صنعته روسيا المجرمة بحق الشعب السوري,
والأهم ذلك كله هو إلغاء كامل للمطلب الأول وهو العملية الانتقالية وإقامة هيئة حكم انتقالية ذات صلاحيات تنفيذية كاملة هي وحدها صاحبة الحق بإعادة النظر بالنظام الدستوري والمنظومة القانونية، بما معناه الحرفي التنازل التام عن مطلب الانتقال لدولة ديمقراطية،
وهذا يؤدي بناء للمسألة الأخطر بموضوع اللجنة الدستورية وهو إعادة الشرعية لنظام القتل أن يقود كل العملية السياسية وبشروطه وحده، ومنحه كل الحق أن يحدد مسار وحدود ما يجري, وتقديم العذر والمبرر للمجتمع الدولي ليترك الشعب السوري لمصيره الأسود دون تدخل باعتبار أن " ممثلي الشعب " قد قبلوا بهذا المسار للوصول لطلباتهم ولا داعي لمسارات مختلفة،
وأن " ممثلي الشعب المعارض " قبلوا بالسير بهذا المسار رغم عدم وقف القتل بكل أشكاله ورغم عدم إطلاق سراح المعتقلين ورغم عدم محاسبة المجرمين ورغم عدم السماح للأمم المتحدة والمنظمات الدولية بالوصول لكل السوريين المحتاجين، لذلك لا يمكن لوم المجتمع الدولي فلن يكون ملكيا أكثر من الملك،
إننا إذ نؤكد الرفض التام للجنة الدستورية باعتبار القبول والسير فيها سيكون أكبر انتكاسة لمطالب الشعب السوري لأنها تعطي المبرر من قبل من يعتبر " ممثل لمطالب الشعب السوري المعارض" للمجتمع الدولي أن يستمر بتجاهله لمعاناة هذا الشعب ويعيد الشرعية لنظام مجرم قاتل أقر كل العالم بجرائمه وبدأت جهات قضائية بإصدار مذكرات توقيف دولية بحق رموزه،
ويتنازل بكل وقاحة عن أهم مكسبين للشعب السوري وهما بيان جنيف 1 وقرار مجلس الأمن 2254 ,
والأهم أنه يتجاهل معاناة أكثر من مائة وخمسين ألف معتقل مازالوا مغيبين قسرا ومجهولي المصير ومعاناة عوائلهم، ويتجاهل أكثر من خمسين ألف ضحية قتلوا تحت التعذيب وأخفيت جثثهم، ويتجاهل استمرار القتل والتدمير بكل أنواع الأسلحة للشعب والمدن السورية.
كان من المفروض أن يكون عمل هذه اللجنة موجها للعمل على هيئة الحكم الانتقالي وكنا سنقبل أي اختيارات لهذه الهيئة لأنها تعبر عن بداية الحل وليس إغلاق مساراته كما قامت به اللجنة الدستورية،
إن اللجنة الدستورية لم ولن تكون خطوة على طريق تحقيق مطالب الشعب السوري لدولة الكرامة والحرية بل يغلق الطريق إليها نهائيا وكأن كل تضحيات الشعب السوري ذهبت هدرا ويفتح طريقا أسودا لسوريا يجب أن نرفض السير به
لذلك نطالب الجميع وكل من يهمه مستقبل سوريا أن يعلن رفضه للجنة الدستورية كمسار وخطوة مطلوبة الآن، وأن يتم إنشاء تحالف القوى السورية المؤمنة بسوريا ديمقراطية مدنية خالية من الاستبداد بكل أشكاله لوأد مسار اللجنة الدستورية
وإننا ندعو من ظن أنه يقدم شيئا إيجابيا للشعب السوري بدخوله هذا المستنقع أن يعلن انسحابه ومقاطعته لهذه اللجنة ربما هذا لن يعيد الثقة به ولكن على الأقل للحفاظ على ماء وجهه،
ونطالب المجتمع الدولي بالالتزام بقراراته والتزاماته والعمل على إنشاء هيئة حكم انتقالي خلال مدة ستة أشهر كما نص عبه بيان جنيف 1 تكون لها كامل الصلاحية التنفيذية ويتم الاعتراف بها دوليا لتقوم بالمهام المنوطة بها بموجب القرارات الدولية لوضع سوريا على سكة الحل المؤدي لسلامة سوريا وطنا وشعبا وليس على سكة الدمار والتدمير
كما نطالب المجتمع الدولي أن يمتنع عن إجراء أي مفاوضات أو محادثات مع مجرمي الحرب والمجرمين ضد الإنسانية من كل الأطراف والذين أصبحوا موضع اتهام أمام الجهات القضائية وصدرت مذكرات توقيف بحق عدد منهم واعتبار هؤلاء خارج أي حل سياسي أو ان يكونوا جزء من مستقبل سوريا،
بهذا فقط يمكن أن نصدق أن قيم حقوق الإنسان وقيم الكرامة والحرية والعدالة ما زالت موجودة ويؤمن ويعمل لها أحد ما بهذا العالم وأن الدول تحترم التزاماتها وقرارتها وإلا فلا معنى لأي قانون ولا لأي ضابط ولا يمكن لوم أي خارج عن القانون من قبل من لا يلتزم به.
